(Create Technologies
Personal Mobility Device Trial —
Exemption) Order 2021
In exercise of the powers conferred by section 66 of the Active Mobility Act 2017, the Minister for Transport makes the following Order:
Citation and period in force
1.—(1)  This Order is the Active Mobility (Create Technologies Personal Mobility Device Trial — Exemption) Order 2021.
(2)  This Order is in force for the period between 18 January 2021 and 18 May 2021 (both dates inclusive).
Definitions
2.  In this Order —
“Create Technologies” means the company incorporated under the Companies Act (Cap. 50) as Create Technologies Pte. Ltd. (UEN 201719412G);
“specified personal mobility device” means a personal mobility device that —
(a)has handlebars;
(b)is propelled by an electric motor attached to the personal mobility device;
(c)has a maximum speed not exceeding 25 km/h under all circumstances;
(d)has an unladen weight not exceeding 20 kilograms;
(e)has a width not exceeding 700 millimetres; and
(f)is fitted with a global navigation satellite system developed by Create Technologies and used for the purpose of the trial;
“specified shared paths” means the shared paths specified in the Schedule;
“trial” means the trial conducted by Create Technologies to test the global navigation satellite system that has been fitted on the specified personal mobility device;
“unladen weight” and “width” have the meanings given by regulation 4(2) of the Active Mobility Regulations 2018 (G.N. No. S 251/2018).
Exemption for riding specified personal mobility device
3.—(1)  Sections 19(1)(c), 20A and 28B(1) of the Act do not apply to an individual riding a specified personal mobility device (called in this paragraph a rider) on any of the specified shared paths during the trial times mentioned in sub‑paragraph (2) and in connection with the trial, under the following conditions:
(a)the rider has attained 16 years of age and is authorised by Create Technologies to ride the specified personal mobility device;
(b)the rider, when riding the specified personal mobility device —
(i)wears a light-coloured vest bearing the logo of Create Technologies; and
(ii)gives way to other users of the specified shared path;
(c)the specified personal mobility device does not carry, at any time, any other person;
(d)no other specified personal mobility device is ridden on the specified shared path when the rider is riding the specified personal mobility device;
(e)there is in force, at any time the specified personal mobility device is used in connection with the trial, a policy of insurance in relation to the specified personal mobility device insuring against any liability in respect of the death of or bodily injury sustained by any person (other than the rider), or property damage suffered by any person (other than the rider), caused by or arising out of the use of the specified personal mobility device;
(f)the risk under the policy of insurance mentioned in sub‑paragraph (e) is assumed by an insurer who, at the time of the issuance of the policy, is lawfully carrying on an insurance business in Singapore.
(2)  The trial times are from 11 a.m. to 3 p.m. daily, between 18 January 2021 and 18 May 2021 (both dates inclusive).
Exemption for Create Technologies
4.  Section 28B(2) of the Act does not apply to Create Technologies where it causes or permits an individual exempt under paragraph 3 to ride a specified personal mobility device on any of the specified shared paths.
