Road Traffic Act

Road Traffic (Motor Vehicles, Quota System) (Amendment) Rules 2004
In exercise of the powers conferred by section 10A(4) of the Road Traffic Act, the Minister for Transport hereby makes the following Rules:
Citation and commencement
1.  These Rules may be cited as the Road Traffic (Motor Vehicles, Quota System) (Amendment) Rules 2004 and shall come into operation on 2nd August 2004.
Amendment of rule 24
2.  Rule 24 of the Road Traffic (Motor Vehicles, Quota System) Rules (R 31) is amended —
(a)by deleting the words “may renew” in paragraph (2) and substituting the words “may, subject to such conditions as he thinks fit, renew”;
(b)by deleting paragraph (3A); and
(c)by inserting, immediately after paragraph (8), the following paragraphs:
(9)  Where any cheque is tendered as payment or part payment for any fee or levy referred to in paragraph (3) or (7), nothing in this rule shall require the Registrar to renew or restore a certificate of entitlement, as the case may be, until the cheque has been honoured.
(10)  For the purposes of this rule, where —
(a)an application has been made to renew or restore a certificate of entitlement;
(b)one or more cheques are tendered as payment or part payment of any fee or levy referred to in paragraph (3) or (7) which is payable in respect of the application; and
(c)any such cheque is not honoured on presentation or is subsequently dishonoured,
an administrative fee of $20 shall be payable in respect of the application.
(11)  The Registrar may waive, in whole or in part, the fee payable under paragraph (3)(b) or (10).”.
Amendment of rule 24A
3.  Rule 24A of the Road Traffic (Motor Vehicles, Quota System) Rules is amended by deleting paragraph (1A) and substituting the following paragraphs:
(1A)  Where any cheque is tendered as payment or part payment for any fee or levy referred to in paragraph (1)(a) or (b), nothing in this rule shall require the Registrar to renew a certificate of entitlement, until the cheque has been honoured.
(1B)  For the purposes of this rule, where —
(a)an application has been made to renew a certificate of entitlement;
(b)one or more cheques are tendered as payment or part payment of any fee or levy referred to in paragraph (1)(a) or (b) which is payable in respect of the application; and
(c)any such cheque is not honoured on presentation or is subsequently dishonoured,
an administrative fee of $20 shall be payable in respect of the application.
(1C)  The Registrar may waive, in whole or in part, the fee payable under paragraph (1)(b) or (1B).”.
