Family Justice (Amendment) Rules 2018

In exercise of the powers conferred on us by section 46 of the Family Justice Act 2014 and all other powers enabling us under any written law, we, the Family Justice Rules Committee, make the following Rules:

Citation and commencement

1. These Rules are the Family Justice (Amendment) Rules 2018 and come into operation on 15 March 2018.

Amendment of rule 947

2. Rule 947 of the Family Justice Rules 2014 (G.N. No. S 813/2014) (called in these Rules the principal Rules) is amended by inserting, immediately after the definition of “foreign country”, the following definition:

“ “specified court” means a court that is specified in rule 952A;”.

Amendment of rule 948

3. Rule 948 of the principal Rules is amended —

(a)	by deleting the words “court of competent jurisdiction” in paragraph (1) and substituting the words “specified court”; and
(b)	by deleting the words “court in a” in paragraph (3) and substituting the words “specified court in the”.

Amendment of rule 951

4. Rule 951(1) of the principal Rules is amended by deleting the words “court of competent jurisdiction” and substituting the words “specified court”.

Deletion and substitution of rule 952 and new rule 952A

5. Rule 952 of the principal Rules is deleted and the following rules substituted therefor:

“Specified foreign countries

952. For the purposes of this Division, each of the following is a specified foreign country:

(a)	New South Wales, Australia;
(b)	Dubai, United Arab Emirates;
(c)	Bermuda.

Specified courts

952A. For the purposes of this Division —

(a)	where the specified foreign country is New South Wales, Australia, every court of competent jurisdiction in New South Wales, Australia is a specified court;
(b)	where the specified foreign country is Dubai, United Arab Emirates, every court of competent jurisdiction which forms part of the Dubai International Financial Centre Courts is a specified court; and
(c)	where the specified foreign country is Bermuda, the Supreme Court of Bermuda is a specified court.”.
