Central Provident Fund Act
(Chapter 36)
Central Provident Fund (Medisave Account Withdrawals) (Amendment No. 2) Regulations 2009
In exercise of the powers conferred by section 77(1)(j) of the Central Provident Fund Act, the Minister for Manpower, after consulting with the Central Provident Fund Board, hereby makes the following Regulations:
Citation and commencement
1.—(1)   These Regulations may be cited as the Central Provident Fund (Medisave Account Withdrawals) (Amendment No. 2) Regulations 2009 and shall, with the exception of regulations 2, 6, 7, 10, 11 and 12, come into operation on 1st June 2009.
(2)  Regulations 2, 6, 7, 10, 11 and 12 shall come into operation on 1st October 2009.
Amendment of regulation 2
2.  Regulation 2(1) of the Central Provident Fund (Medisave Account Withdrawals) Regulations (Rg 17) (referred to in these Regulations as the principal Regulations) is amended —
(a)by deleting the definition of “approved chronic illness treatment” and substituting the following definition:
“ “approved chronic illness treatment” means any medical treatment or psychiatric treatment in respect of any chronic illness which is approved by the Minister for Health for the purposes of these Regulations;”;
(b)by inserting, immediately after the words “medical treatment” in the definition of “approved CIT medical institution”, the words “or psychiatric treatment”;
(c)by deleting the words “First Schedule” in the definitions of “approved medical treatment” and “radiotherapy treatment” and substituting in each case the word “Schedule”; and
(d)by deleting the words “the third column of the Second Schedule” in the definitions of “co-payment amount” and “co-payment percentage” and substituting in each case the words “regulation 14(1)(a)”.
Amendment of regulation 4
3.  Regulation 4(6) of the principal Regulations is amended by inserting, immediately after the words “Minister for Health” wherever they appear, the words “or such person as he may appoint”.
Amendment of regulation 5
4.  Regulation 5(1) of the principal Regulations is amended by deleting sub-paragraph (B) of sub-paragraph (a)(ii) and substituting the following sub-paragraph:
(b)the amount of operation fees for a maximum of 3 surgical procedures, involving not more than 2 anatomical systems and not more than 2 procedures within each system, which shall not exceed the lower of the following cap amounts:
(BA)the amount as determined by the Minister for Health for such operation or operations; or
(BB)a total of $5,000 (if he was admitted to the approved hospital before 1st June 2009) or $7,550 (if he was admitted to the approved hospital on or after 1st June 2009);”.
Amendment of regulation 6
5.  Regulation 6(1) of the principal Regulations is amended by deleting sub-paragraph (B) of sub-paragraph (a)(ii) and substituting the following sub-paragraph:
(b)the amount of operation fees for a maximum of 3 surgical procedures, involving not more than 2 anatomical systems and not more than 2 procedures within each system, which shall not exceed the lower of the following cap amounts:
(BA)the amount as determined by the Minister for Health for such operation or operations; or
(BB)a total of $5,000 (if he was admitted to the approved community hospital before 1st June 2009) or $7,550 (if he was admitted to the approved community hospital on or after 1st June 2009); or ”.
Amendment of regulation 13
6.  Regulation 13 of the principal Regulations is amended by deleting the words “First Schedule” in paragraphs (2), (3) and (6) and substituting in each case the word “Schedule”.
Amendment of regulation 14
7.  Regulation 14(1) of the principal Regulations is amended —
(a)by deleting the words “applicable co-payment amount” in the definition of B in sub-paragraph (a)(ii) and substituting the words “co-payment amount of $30”; and
(b)by deleting the words “applicable co-payment percentage” in the definition of C in sub-paragraph (a)(ii) and substituting the words “co-payment percentage of 15%”.
Amendment of regulation 16
8.  Regulation 16 of the principal Regulations is amended —
(a)by inserting, immediately after “$5,000” in paragraph (2)(b)(ii), the words “(if she was admitted to the approved hospital before 1st June 2009) or $7,550 (if she was admitted to the approved hospital on or after 1st June 2009)”; and
(b)by inserting, immediately after “$5,000” in paragraph (6)(b)(ii), the words “(if she was admitted to the approved hospital before 1st June 2009) or $7,550 (if she was admitted to the approved hospital on or after 1st June 2009)”.
Amendment of regulation 21
9.  Regulation 21(1) of the principal Regulations is amended by deleting sub-paragraph (c) and substituting the following sub-paragraph:
(c)the payment of operation fees for a maximum of 3 surgical procedures, involving not more than 2 anatomical systems and not more than 2 procedures within each system, shall not exceed the lower of the following cap amounts:
(i)the amount as determined by the Minister for Health for such operation or operations; or
(ii)a total of $5,000 (for day surgical treatment received before 1st June 2009) or $7,550 (for day surgical treatment received on or after 1st June 2009);”.
Renaming of First Schedule
10.  The principal Regulations are amended by deleting the words “FIRST SCHEDULE” in the heading and substituting the words “THE SCHEDULE”.
Deletion of Second Schedule
11.  The Second Schedule to the principal Regulations is deleted.
Savings and transitional provision
12.  Regulations 2, 6, 7, 10 and 11 shall not affect any approved chronic illness treatment or treatment package commenced before 1st October 2009, and every such treatment or treatment package may be continued on or after that date as if the treatment or treatment package had been approved by the Minister for Health.
