Air Navigation Act
(Chapter 6)
Air Navigation (Licensing of Air Services) (Amendment No. 2) Regulations 2010
In exercise of the powers conferred by section 16 of the Air Navigation Act, the Minister for Transport hereby makes the following Regulations:
Citation and commencement
1.  These Regulations may be cited as the Air Navigation (Licensing of Air Services) (Amendment No. 2) Regulations 2010 and shall come into operation on 1st July 2010.
Amendment of regulation 2M
2.  Regulation 2M of the Air Navigation (Licensing of Air Services) Regulations (Rg 2) is amended —
(a)by inserting, immediately after the words “to provide” in paragraph (1)(f)(i), the words “under a Category A licence”;
(b)by deleting the words “for a period of 3 consecutive months or more” in paragraph (1)(f)(ii) and substituting the words “under a Category A licence for any cumulative period of 2 months”; and
(c)by inserting, immediately after paragraph (1), the following paragraphs:
“(1A)  Where a licence is issued to a licensee on or after 1st July 2010, the first of the 6-month period referred to in paragraph (1)(f)(ii) shall commence from the date the licence was issued.
(1B)  Where a licence is issued to a licensee before 1st July 2010 and the licensee has not, as at that date, contravened paragraph (1)(f)(ii) in force immediately before that date, the first of the 6-month period referred to in paragraph (1)(f)(ii) shall commence from 1st July 2010 in respect of that licence.”.
Transitional provision
3.  Notwithstanding these Regulations, the Committee referred to in regulation 2M(1) of the Air Navigation (Licensing of Air Services) Regulations (Rg 2) may suspend, revoke or vary the licence of any licensee who has, before 1st July 2010, contravened regulation 2M(1)(f)(ii) of the Air Navigation (Licensing of Air Services) Regulations in force immediately before that date.
