(Motor Vehicles, Quota System)
(Amendment No. 2) Rules 2013
In exercise of the powers conferred by section 10A(4) of the Road Traffic Act, the Minister for Transport hereby makes the following Rules:
Citation and commencement
1.  These Rules may be cited as the Road Traffic (Motor Vehicles, Quota System) (Amendment No. 2) Rules 2013 and shall be deemed to have come into operation on 25th February 2013.
Amendment of rule 24
2.  Rule 24 of the Road Traffic (Motor Vehicles, Quota System) Rules (R 31) is amended —
(a)by deleting paragraph (2) and substituting the following paragraphs:
(2)  The Registrar may, subject to such conditions as he thinks fit, renew a certificate of entitlement —
(a)in respect of any vehicle not falling within the category of vehicles referred to in rule 3(1)(c), for a period of 5 or 10 years, commencing from the date of the renewal or such other date as the Registrar may specify in any particular case, except that where a certificate of entitlement is renewed for a period of 5 years, it shall not be further renewed on its expiry; or
(b)in respect of any vehicle falling within the category of vehicles referred to in rule 3(1)(c), for a period of 5 or 10 years, commencing from the date of the renewal or such other date as the Registrar may specify in any particular case, except that where a certificate of entitlement is renewed for a period of 5 years, each subsequent renewal shall only be for a period of 5 years.
(2AA)  The Registrar may renew a certificate of entitlement under paragraph (2) in respect of a vehicle only if the Registrar issues a licence under section 13 of the Act in respect of that vehicle.”; and
(b)by deleting the words “paragraph (2)” in paragraph (2A) and substituting the words “paragraph (2)(a)”.
Savings and transitional provision
3.—(1)  Where, between 25th February 2013 and 13th March 2013 (both dates inclusive), the Registrar has cancelled the registration of any vehicle falling within the category of vehicles referred to in rule 3(1)(c) of the Road Traffic (Motor Vehicles, Quota System) Rules upon the expiry of a certificate of entitlement (which was valid for 5 years) issued in respect of that vehicle, the person who was registered as the owner of that vehicle immediately before the expiry of the certificate of entitlement may apply for the renewal of a certificate of entitlement in respect of that vehicle in accordance with rule 24 of the Road Traffic (Motor Vehicles, Quota System) Rules as amended by these Rules.
(2)  Notwithstanding any other provision in rule 24 of the Road Traffic (Motor Vehicles, Quota System) Rules as amended by these Rules, any person who makes an application for the renewal of a certificate of entitlement under paragraph (1) must do so on or before 19th March 2013 or such other date as the Registrar may specify in any particular case.
