Societies (Amendment) Regulations 2004

In exercise of the powers conferred by section 34 of the Societies Act, the Minister for Home Affairs hereby makes the following Regulations:

Citation and commencement

1. These Regulations may be cited as the Societies (Amendment) Regulations 2004 and shall come into operation on 1st September 2004.

Amendment of regulation 2

2. Regulation 2 of the Societies Regulations (Rg 1) is amended —

(a)

by deleting the definition of “approved company auditor”; and

(b)

by deleting the full-stop at the end of the definition of “proceed” and substituting a semi-colon, and by inserting immediately thereafter the following definition:

“ “qualified company auditor” means a person qualified for appointment as a company auditor under section 10 of the Companies Act (Cap. 50).”.

Amendment of regulation 3

3. Regulation 3 of the Societies Regulations is amended —

(a)

by deleting the words “be in quadruplicate and shall” in paragraph (2)(a);

(b)

by deleting sub-paragraph (b) of paragraph (2) and substituting the following sub-paragraph:

“(b)	be accompanied by a copy of the society’s rules in the English language, and where the society’s rules are in a language other than English, be accompanied by a copy of an English translation of the rules.”; and

(c)

by deleting paragraph (3) and substituting the following paragraphs:

“(3) Subject to paragraph (3A), no person shall organise or take part in any activity of or on behalf of any society —

(a)	in the case of a specified society, before the publication in the Gazette of a notification under section 4 of the Act to the effect that the society has been registered; or
(b)	in any other case, before the receipt by the person or persons making the application for registration of notice in writing from the Registrar that the society has been registered.

(3A) The activity referred to in paragraph (3) shall not include —

(a)	any application to or correspondence with the Registrar; and
(b)	any activity which has been approved in writing by the Registrar.”.

Amendment of regulation 7

4. Regulation 7(1) of the Societies Regulations is amended by deleting the words “, in duplicate,” in the 6th line.

Amendment of regulation 8

5. Regulation 8(2) of the Societies Regulations is amended by deleting the words “5 copies” and substituting the words “a copy”.

Amendment of regulation 10

6. Regulation 10 of the Societies Regulations is amended by deleting paragraph (1) and substituting the following paragraph:

“(1) The following fees shall be payable upon :

(a) approval of the registration of a specified society

$400

(b) registration of a society other than a specified society

$200

$40

(d) approval of a change of name of a registered society

$70

(e) approval of any amendment of the rules of a registered society

$130

(f) consent to the use of a flag, a symbol, an emblem, a badge or other insignia by a registered society

$40.”.

Miscellaneous amendments

7. The Societies Regulations are amended —

(a)

by deleting the words “approved company auditor” in the following regulations and substituting in each case the words “qualified company auditor”:

Regulations 4(1)(b)(ii), 5 and 7(1)(b)(ii); and

(b)

by deleting the regulation heading of regulation 5 and substituting the following regulation heading:

“Qualified company auditor’s report”.
