(Control Order) (Amendment No. 5)
Regulations 2021
In exercise of the powers conferred by section 34(1) of the COVID‑19 (Temporary Measures) Act 2020, the Minister for Health makes the following Regulations:
Citation and commencement
1.  These Regulations are the COVID‑19 (Temporary Measures) (Control Order) (Amendment No. 5) Regulations 2021 and come into operation on 24 April 2021.
Amendment of regulation 2
2.  Regulation 2(1) of the COVID‑19 (Temporary Measures) (Control Order) Regulations 2020 (G.N. No. S 254/2020) (called in these Regulations the principal Regulations) is amended —
(a)by inserting, immediately after the definition of “business”, the following definition:
“ “cleared status” has the meaning given by the Infectious Diseases (Mass Gathering Testing for Coronavirus Disease 2019) Regulations 2021 (G.N. No. S 273/2021);”;
(b)by deleting the words “recreational or sporting activity” in paragraph (a) of the definition of “education business” and substituting the words “recreational activity or sporting activity but not a sporting event”;
(c)by inserting, immediately after the definition of “enforcement officer”, the following definition:
“ “enhanced entry control”, for any room or place where a wedding takes place or is to take place, means a requirement to establish and maintain, during the restricted period of the wedding (within the meaning of the Infectious Diseases (Mass Gathering Testing for Coronavirus Disease 2019) Regulations 2021), all reasonably practicable procedures and protocols that ensure that any guest, without a cleared status, does not enter or remain within the room or place where the wedding takes place, or is to take place, during that period;”;
(d)by inserting, immediately after the words “or funeral procession” in the definition of “funeral event”, the words “held during or before the burial or cremation of the deceased”;
(e)by inserting, immediately after the words “residence and” in paragraph (b) of the definition of “funerary memorial event”, the words “is held”;
(f)by inserting, immediately after the definition of “in the course of employment”, the following definitions:
“ “live performance” has the meaning given by regulation 2(1) of the COVID‑19 (Temporary Measures) (Performances and Other Activities — Control Order) Regulations 2020 (G.N. No. S 927/2020);
“major business event” means a business event to which the COVID‑19 (Temporary Measures) (Major Business Events — Control Order) Regulations 2021 (G.N. No. S 278/2021) applies;”;
(g)by deleting “98” in paragraph (a)(i) of the definition of “maximum permissible group size” and substituting “248”;
(h)by deleting sub‑paragraph (i) of paragraph (b) of the definition of “maximum permissible group size” and substituting the following sub‑paragraph:
(i)50 individuals attending the funeral event at any time on the day of the burial or cremation of the deceased, and 30 individuals attending the funeral event at any time during any other time of the funeral event; or”;
(i)by inserting the word “or” at the end of paragraph (e) of the definition of “maximum permissible group size”;
(j)by deleting paragraph (ea) of the definition of “maximum permissible group size”; and
(k)by inserting, immediately after the definition of “specified symptom”, the following definitions:
“ “sporting activity” and “sporting event” have the meanings given by regulation 2(1) of the COVID‑19 (Temporary Measures) (Sporting Events and Activities — Control Order) Regulations 2021 (G.N. No. S 277/2021);”.
Amendment of regulation 3B
3.  Regulation 3B of the principal Regulations is amended —
(a)by deleting the word “or” at the end of paragraph (d);
(b)by deleting the word “or” at the end of paragraph (e)(i);
(c)by deleting the comma at the end of sub‑paragraph (ii) of paragraph (e) and substituting the word “; or”, and by inserting immediately thereafter the following sub‑paragraph:
(iii)a speaker engaged in public speaking at a major business event,”; and
(d)by deleting the full‑stop at the end of paragraph (e) and substituting the word “; and”, and by inserting immediately thereafter the following paragraph:
(f)if the individual is an athlete or a contestant participating in a sporting activity played or conducted at a sporting event, but only to the extent and in the circumstances authorised by these Regulations or the COVID‑19 (Temporary Measures) (Sporting Events and Activities — Control Order) Regulations 2021 where the extent or circumstances are expressly provided by these or those Regulations.”.
Amendment of regulation 4
4.  Regulation 4(4) of the principal Regulations is amended by deleting the full‑stop at the end of sub‑paragraph (ii) of paragraph (b) and substituting a semi‑colon, and by inserting immediately thereafter the following sub‑paragraph:
(iii)if the individual’s ordinary place of residence is used for the purpose of a funeral event — the number of individuals not ordinarily resident in that place who attend the funeral event and are within the maximum permissible group size allowed under these Regulations during the funeral event.”.
Amendment of regulation 7
5.  Regulation 7(2) of the principal Regulations is amended —
(a)by deleting the word “or” at the end of sub‑paragraph (d); and
(b)by deleting the full‑stop at the end of sub‑paragraph (e) and substituting the word “; or”, and by inserting immediately thereafter the following sub‑paragraph:
(f)if the individual is an athlete or a contestant participating in a sporting activity played or conducted at a sporting event, and in a circumstance that the COVID‑19 (Temporary Measures) (Sporting Events and Activities — Control Order) Regulations 2021 allow for a shorter or no distance between individuals.”.
Amendment of regulation 7A
6.  Regulation 7A(2A) of the principal Regulations is amended by inserting, immediately after sub‑paragraph (c), the following sub‑paragraph:
(ca)where more than 98 but not more than 248 guests are invited to attend the solemnization of the marriage, to ensure that the parties to the marriage have a cleared status before they enter the room or place;”.
Amendment of regulation 8
7.  Regulation 8(1) of the principal Regulations is amended by inserting, immediately after sub‑paragraph (cb), the following sub‑paragraph:
(cc)where more than 98 but not more than 248 guests are invited to attend the wedding, to comply with the enhanced entry controls;”.
Amendment of regulation 13
8.  Regulation 13 of the principal Regulations is amended —
(a)by inserting, immediately after the words “in relation to that business” in paragraph (1)(d), the words “, unless a live performance or sporting event is involved”;
(b)by inserting, immediately after the words “in relation to its business” in paragraph (1)(f), the words “, unless the event, function, ceremony, conference, exhibition or the like is a live performance, sporting event or major business event”; and
(c)by deleting sub‑paragraphs (a) and (b) of paragraph (2) and substituting the following sub-paragraphs:
(a)the number of individuals attending the funeral event does not exceed the maximum permissible group size;
(b)the measures mentioned in regulations 10B(1)(b), (c) and (k) and 12 are implemented in relation to the premises where the funeral event is held, as if —
(i)the premises (even if a place of residence) were permitted premises; and
(ii)every individual attending the funeral event were a customer; and”.
Amendment of regulation 13F
9.  Regulation 13F of the principal Regulations is amended —
(a)by deleting the words “A sporting contest for permitted enterprise workers, or an annual dinner and dance,” in the Examples of impermissible gatherings in paragraph (1) and substituting the words “An annual dinner and dance for more than 8 permitted enterprise workers”;
(b)by deleting sub‑paragraph (b) of paragraph (2);
(c)by deleting sub‑paragraph (b) of paragraph (3); and
(d)by deleting paragraph (6) and substituting the following paragraph:
(6)  Paragraphs (2), (3) and (3A) do not apply to the holding of —
(a)a sporting event;
(b)a media conference;
(c)a live performance; or
(d)a major business event,
but to avoid doubt, this regulation does not prohibit a permitted enterprise causing an event involving an organised gathering in person that is an event mentioned in sub‑paragraph (a), (b), (c) or (d) if that is held in compliance with the COVID‑19 (Temporary Measures) (Performances and Other Activities — Control Order) Regulations 2020, the COVID‑19 (Temporary Measures) (Sporting Events and Activities — Control Order) Regulations 2021 or the COVID‑19 (Temporary Measures) (Major Business Events — Control Order) Regulations 2021, whichever being applicable.”.
Amendment of Part 6 of First Schedule
10.  Paragraph 1 of Part 6 of the First Schedule to the principal Regulations is amended by deleting the words “and where there is a live performance or a media conference at the gathering, the number of audience members at the live performance or individuals present at the media conference (as the case may be) is in compliance with the COVID‑19 (Temporary Measures) (Performances and Other Activities — Control Order) Regulations 2020”.
