Building Control (Amendment No. 3) Regulations 2008

In exercise of the powers conferred by section 49 of the Building Control Act, the Minister for National Development hereby makes the following Regulations:

Citation and commencement

1.—(1) These Regulations may be cited as the Building Control (Amendment No. 3) Regulations 2008 and shall, with the exception of regulation 4, come into operation on 18th December 2008.

(2) Regulation 4 shall be deemed to have come into operation on 1st October 2008.

Amendment of regulation 23A

2. Regulation 23A of the Building Control Regulations 2003 (G.N. No. S 666/2003) (referred to in these Regulations as the principal Regulations) is amended by deleting the words “$5 million” in paragraphs (1) and (2) and substituting in each case the words “$7.5 million”.

Amendment of regulation 24

3. Regulation 24(1) of the principal Regulations is amended —

(a)	by deleting the words “$5 million” in sub-paragraph (a) and substituting the words “$7.5 million”;
(b)	by deleting the words “$10 million” in sub-paragraphs (a) and (b) and substituting in each case the words “$15 million”;
(c)	by deleting the words “$20 million” in sub-paragraphs (b) and (c) and substituting in each case the words “$30 million”;
(d)	by deleting the words “$50 million” in sub-paragraphs (c) and (d) and substituting in each case the words “$75 million”; and
(e)	by deleting the words “$100 million” in sub-paragraphs (d) and (e) and substituting in each case the words “$150 million”.

Amendment of First Schedule

4. Paragraph 1 of the First Schedule to the principal Regulations is amended by deleting the full-stop at the end of sub-paragraph (q) and substituting a semi-colon, and by inserting immediately thereafter the following sub-paragraph:

“(r)

any retaining wall or earth-retaining structure for supporting the face of an excavation made for the purpose of constructing any pile cap, footing, sump, lift pit or trench, provided that the size of the pile cap, footing, sump, lift pit or trench does not exceed 10 square metres in area and 2 metres in depth.”.

Amendment of Eighth Schedule

5. Part I of the Eighth Schedule to the principal Regulations is amended by deleting the words “where a caisson, raft or piled-raft foundation is adopted” in paragraph 3(b) and substituting the words “where jacked-in piles or driven piles or bored cast in-place piles or barrettes are adopted”.

Saving and transitional

6. Nothing in these Regulations shall apply to any underground building works which started before 1st October 2008.
