Children and Young Persons Act
(Chapter 38)
Children and Young Persons (Approved Schools and Approved Homes) (Amendment) Regulations 2001
In exercise of the powers conferred by section 64 of the Children and Young Persons Act, the Director of Social Welfare, with the approval of the Minister for Community Development and Sports, hereby makes the following Regulations:
Citation and commencement
1.  These Regulations may be cited as the Children and Young Persons (Approved Schools and Approved Homes) (Amendment) Regulations 2001 and shall come into operation on 1st October 2001.
Amendment of regulation 2
2.  Regulation 2 of the Children and Young Persons (Approved Schools and Approved Homes) Regulations (Rg 1) (referred to in these Regulations as the principal Regulations) is amended —
(a)by deleting the definition of “home” and substituting the following definitions:
“ “home” means an approved home;
“officer” means any person assisting the superintendent in the management and control of any school or home;”; and
(b)by deleting the definition of “school” and substituting the following definition:
“ “school” means an approved school;”.
Amendment of regulation 3
3.  Regulation 3 (2) of the principal Regulations is amended by deleting sub-paragraph (c) and substituting the following sub-paragraph:
(c)security and other safety measures; and”.
Amendment of regulation 5
4.  Regulation 5 of the principal Regulations is amended by inserting, immediately after paragraph (4), the following paragraph:
(5)  Where a resident escapes from a home or from the custody of an officer thereof, the superintendent shall immediately make a report of the escape to the police, the Director and the parents or guardian of the resident.”.
Amendment of regulation 6
5.  Regulation 6 of the principal Regulations is amended by deleting paragraph (1) and substituting the following paragraph:
(1)  The personal effects of a resident shall, upon his admission to a school or home, be taken from him by the superintendent and, subject to paragraph (2), such personal effects shall be handed over to the parents or guardian of the resident as soon as possible or otherwise returned to the resident upon his discharge from the school or home.”.
Deletion and substitution of regulation 8
6.  Regulation 8 of the principal Regulations is deleted and the following regulation substituted therefor:
Provision of proper sleeping space, personal effects, etc.
8.  Every resident shall be provided with a proper sleeping space, clothing and such other personal effects as may be necessary for his stay in the school or home.”.
Amendment of regulation 11
7.  Regulation 11 (1) of the principal Regulations is amended —
(a)by deleting sub-paragraph (a) and substituting the following sub-paragraph:
(a)moral or religious guidance;”;
(b)by deleting the word “and” at the end of sub-paragraph (e); and
(c)by deleting the full-stop at the end of paragraph (f) and substituting the word “; and”, and by inserting immediately thereafter the following sub-paragraph:
(g)individual and group therapy.”.
Amendment of regulation 13
8.  The principal Regulations are amended by renumbering regulation 13 as paragraph (1) of that regulation, and by inserting immediately thereafter the following paragraph:
(2)  A resident who has been granted leave under paragraph (1) shall abide by the following conditions:
(a)he shall return to the school or home immediately upon the expiration of the period of leave granted to him;
(b)he shall remain indoors from 10 p.m. to 6 a.m.;
(c)he shall not visit such places as the superintendent may specify as being unsuitable for him to visit;
(d)he shall not consume or have in his possession any controlled drug, intoxicating substance, tobacco or alcoholic drink; and
(e)he shall not behave in a disorderly manner during the period of leave granted to him.”.
Amendment of regulation 14
9.  Regulation 14 of the principal Regulations is amended —
(a)by deleting paragraph (1) and substituting the following paragraph:
(1)  Subject to paragraph (2), the superintendent may grant a resident special leave —
(a)to attend any educational classes or vocational training programmes or to take up any employment, where such educational classes, vocational training programmes or employment is not provided for by the school or home; or
(b)for such other special purpose for which the superintendent thinks fit and proper to grant such special leave to the resident.”;
(b)by deleting the words “under paragraph (1)” in the 1st and 2nd lines of paragraph (2) and substituting the words “under paragraph (1)(a)”;
(c)by inserting, immediately after the words “controlled drug,” in paragraph (2)(d), the words “intoxicating substance,”; and
(d)by inserting, immediately after paragraph (2), the following paragraph:
(3)  A resident who has been granted special leave under paragraph (1)(b) shall abide by the conditions specified in paragraph (2)(a), (c), (d) and (e) and such other conditions as the superintendent may specify.”.
Amendment of regulation 16
10.  Regulation 16 of the principal Regulations is amended —
(a)by inserting, immediately after the words “his parents or guardian” in paragraph (1), the words “during such hours and at such reasonable intervals as the Director may determine”; and
(b)by deleting the words “his friends” in paragraph (2) and substituting the words “such other persons as the superintendent thinks necessary or desirable”.
Deletion of regulation 17
11.  Regulation 17 of the principal Regulations is deleted.
Amendment of regulation 22
12.  Regulation 22 of the principal Regulations is amended —
(a)by inserting, immediately after the word “superintendent” in the last line of paragraph (1), the words “or an officer authorised by him”; and
(b)by deleting paragraphs (2) and (3) and substituting the following paragraphs:
(2)  For the purpose of paragraph (1), any one or more of the following forms of punishment may be imposed on a resident:
(a)forfeiture or curtailment of rewards and privileges or deprivation of social activities for a specified period, except that the privileges forfeited shall not include the reception of visits from the resident’s parents or guardian;
(b)performance of extra duties in and around the buildings or compound of the school or home;
(c)separation from other residents in accordance with regulation 23; and
(d)corporal punishment in accordance with regulation 24.
(3)  The superintendent shall —
(a)record in the discipline book —
(i)the reasons for his decision to impose any punishment on any resident; and
(ii)the form of punishment imposed; and
(b)inform the resident’s parents or guardian as soon as possible of the disciplinary action that has been taken and the punishment that has been imposed on the resident.”.
Amendment of regulation 23
13.  Regulation 23 (2) is amended by deleting sub-paragraph (d) and substituting the following sub-paragraph:
(d)no resident shall be separated from the other residents in the school or home for a period exceeding 30 days except with the prior approval of the Director.”.
Amendment of regulation 24
14.  Regulation 24 is amended —
(a)by deleting sub-paragraph (i) of paragraph (3)(a) and substituting the following sub-paragraph:
(i)it shall be administered by the superintendent or an officer authorised by him in the presence of another officer who shall sign in the punishment book as a witness to the carrying out of the punishment;”;
(b)by deleting “8” in sub-paragraph (iii) of paragraph (3)(a) and substituting “12”;
(c)by deleting sub-paragraph (i) of paragraph (3)(b) and substituting the following sub-paragraph:
(i)it shall be administered by the superintendent or an officer authorised by him in the presence of another officer who shall sign in the punishment book as a witness to the carrying out of the punishment;”; and
(d)by deleting “8” in sub-paragraph (iii) of paragraph (3)(b) and substituting “12”.
Amendment of regulation 27
15.  Regulation 27 of the principal Regulations is amended by deleting the words “7 days” in paragraph (a) and substituting the words “30 days”.
