Chemical Weapons
(Prohibition) (Amendment)
Regulations 2011
In exercise of the powers conferred by sections 9(8), 12, 30 and 33 of the Chemical Weapons (Prohibition) Act, the Minister for Foreign Affairs hereby makes the following Regulations:
Citation and commencement
1.  These Regulations may be cited as the Chemical Weapons (Prohibition) (Amendment) Regulations 2011 and shall come into operation on 1st November 2011.
Amendment of regulation 3
2.  Regulation 3 of the Chemical Weapons (Prohibition) Regulations 2007 (G.N. No. S 669/2007) (referred to in these Regulations as the principal Regulations) is amended —
(a)by deleting paragraph (2) and substituting the following paragraph:
(2)  The holder of a licence to import or export a Schedule 2 chemical shall not transfer the chemical to a country or territory that is not a party to the Convention unless —
(a)the chemical, if it is one specified in item A of Part II of the Schedule to the Act, forms no more than 1% by weight of a mixture or, if it is one specified in item B of Part II of that Schedule, forms no more than 10% by weight of a mixture; or
(b)the mixture is or is part of goods identified as consumer goods and packaged for retail sale for personal use, or packaged for individual use,
and, where the licence is for the export of the chemical, he submits to the Director-General before the export an end-user certificate by the end-user in the country or territory of destination.”; and
(b)by deleting the word “and” at the end of paragraph (4)(a) and substituting the word “or”.
Amendment of regulation 7
3.  Regulation 7 of the principal Regulations is amended by deleting the words “Section 9(1)” and substituting the words “Section 9(2) and (4)”.
Amendment of regulation 9
4.  Regulation 9 of the principal Regulations is amended by deleting the words “numbered document shall be construed as a reference to the current version of the document bearing the corresponding number” and substituting the words “named or numbered document shall be construed as a reference to the current version of the document bearing the corresponding name or number”.
Amendment of regulation 10
5.  Regulation 10 of the principal Regulations is amended —
(a)by deleting the words “document numbers C, 1.1 and 1.4” in paragraph (1) and substituting the words “the Declaration Cover Certification Form and document number C.1”;
(b)by deleting the words “document numbers C, 2.1 and 2.2” in paragraph (2) and substituting the words “the Declaration Cover Certification Form and document number C.2”; and
(c)by deleting the words “document numbers C, 3.1 and 3.2” in paragraph (3) and substituting the words “the Declaration Cover Certification Form and document number C.3”.
Amendment of regulation 11
6.  Regulation 11(1) of the principal Regulations is amended by deleting sub-paragraphs (a) to (d) and substituting the following sub-paragraphs:
(a)in the case of a Schedule 1 chemical, the Declaration Cover Certification Form and document number D.1;
(b)in the case of a Schedule 2 chemical, the Declaration Cover Certification Form and document number D.2;
(c)in the case of a Schedule 3 chemical, the Declaration Cover Certification Form and document number D.3; and
(d)in the case of a discrete organic chemical not listed in the Schedule to the Act, the Declaration Cover Certification Form and document number D.4,”.
Amendment of regulation 13
7.  Regulation 13(a) of the principal Regulations is amended by deleting the words “, 13(4) and 25(1)” and substituting the words “and 13(4)”.
