Town Council of Hong Kah (Conservancy and Service Charges) (Amendment) By-laws 2003
In exercise of the powers conferred by section 24(1) of the Town Councils Act, the Town Council for the Town of Hong Kah hereby makes the following By-laws:
Citation and commencement
1.  These By-laws may be cited as the Town Council of Hong Kah (Conservancy and Service Charges) (Amendment) By-laws 2003 and shall come into operation on 1st March 2003.
Deletion and substitution of by-law 3
2.  By-law 3 of the Town Council of Hong Kah (Conservancy and Service Charges) By-laws (By 56) is deleted and the following by-law substituted therefor:
Goods and services tax
3.  The conservancy and service charges specified in the Schedule are inclusive of the goods and services tax chargeable under the Goods and Services Tax Act (Cap. 117A) on the services in respect of which such conservancy and service charges are payable.”.
Amendment of Schedule
3.  The Schedule to the Town Council of Hong Kah (Conservancy and Service Charges) By-laws is amended —
(a)by deleting the words “Items 1 to 4” immediately below the heading “Monthly conservancy and service charges” in the second column;
(b)by deleting items 5 to 11 and substituting the following items:

(a) shop, kiosk or shoplet with living accommodation
 
$1.56 per square metre of the area of the shop, kiosk or shoplet subject to a minimum of $49.92 in addition to the following conservancy and service charges for the equivalent room type:
(i) 1-room flat
 
$18.72.
(ii) 2-room flat
 
$26.52.
(iii) 3-room flat
 
$36.92.
(iv) 4-room flat
 
$48.88.
(v) 5-room flat
 
$61.88.
(vi) Executive apartment or maisonette
 
$78.00.
(b) shop, kiosk or shoplet without living accommodation
 
$1.56 per square metre of the area of the shop, kiosk or shoplet subject to a minimum of $49.92.
 
 
 
 
8. Commercial property in areas other than those stated in item 7, but including Hillview Estate —
 
 
(a) shop, kiosk or shoplet with living accommodation
 
$1.35 per square metre of the area of the shop, kiosk or shoplet subject to a minimum of $43.68 in addition to the following conservancy and service charges for the equivalent room type:
(i) 1-room flat
 
$18.72.
(ii) 2-room flat
 
$26.52.
(iii) 3-room flat
 
$36.92.
(iv) 4-room flat
 
$48.88.
(v) 5-room flat
 
$61.88.
(vi) Executive apartment or maisonette
 
$78.00.
(b) shop, kiosk or shoplet without living accommodation
 
$1.35 per square metre of the area of the shop, kiosk or shoplet subject to a minimum of $43.68.
 
 
 
 
9.—(1)  Stall —
 
 
(a) cooked food stall
 
$114.40 per 10 square metres of the stall area or part thereof.
(b) fruit, preserved and dried goods, fresh fish and seafood, meat or poultry stall
 
$57.20 per 10 square metres of the stall area or part thereof.
(c) vegetable, bean curd and noodle, egg, ground assorted spices or miscellaneous stall
 
$36.40 per 10 square metres of the stall area or part thereof.
(d) piece and sundry stall
 
$67.60 per 10 square metres of the stall area or part thereof.
(2) 2 or more stalls with total areas exceeding 10 square metres allotted to a stallholder
 
Charges for each additional stall shall be double the conservancy and service charges for the first stall allotted to the stallholder set out in paragraph (1).
 
 
 
 
10. Social Communal Properties
 
$0.14 per square metre of the area of the premises.
 
 
 
 
11. Residents Committee Centre
 
$1.04 per unit.

(c)by deleting the words “items 1 to 4” in paragraphs (1) and (2) under the heading “Note” and substituting in each case the words “items 1 to 6”.
