Road Traffic Act
(Chapter 276)
Road Traffic (Driver Improvement Points System) (Amendment) Rules 2010
In exercise of the powers conferred by section 45(2) of the Road Traffic Act, the Minister for Home Affairs hereby makes the following Rules:
Citation and commencement
1.  These Rules may be cited as the Road Traffic (Driver Improvement Points System) (Amendment) Rules 2010 and shall come into operation on 1st November 2010.
Amendment of rule 2
2.  Rule 2 of the Road Traffic (Driver Improvement Points System) Rules (R 25) (referred to in these Rules as the principal Rules) is amended by deleting the definition of “foreign motorist” and substituting the following definition:
“ “holder of a foreign driving licence” has the same meaning as in section 47F(4) of the Act;”.
Amendment of rule 3
3.  Rule 3 of the principal Rules is amended —
(a)by deleting the words “to a foreign motorist” in paragraph (1) and substituting the words “the holder of a foreign driving licence”; and
(b)by deleting the words “foreign motorists” in paragraph (3) and substituting the words “all holders of foreign driving licences”.
Amendment of rule 5
4.  Rule 5 of the principal Rules is amended by deleting paragraph (3).
Amendment of rule 7
5.  Rule 7 of the principal Rules is amended —
(a)by deleting paragraph (1) and substituting the following paragraph:
(1)  The Deputy Commissioner of Police may by order (referred to in these Rules as a prohibition order) —
(a)prohibit the holder of a foreign driving licence who has been awarded a total of 13 or more demerit points within a period of 12 months from the date of the grant of that licence from driving all classes of vehicles in Singapore for a period of 12 months; or
(b)prohibit the holder of a foreign driving licence who has been awarded a total of 24 or more demerit points within a period of 24 consecutive months from driving all classes of vehicles in Singapore for a period not exceeding 36 months.”;
(b)by deleting the words “a foreign motorist” wherever they appear in paragraphs (2)(a) and (b) and (3) and substituting in each case the words “the holder of a foreign driving licence”;
(c)by deleting the words “the foreign motorist” wherever they appear in paragraphs (2), (4), (5), (6) and (7)(a) and substituting in each case the words “the holder of a foreign driving licence”; and
(d)by deleting the words “foreign motorist” in the rule heading and substituting the words “holder of foreign driving licence”.
Deletion and substitution of rule 8
6.  Rule 8 of the principal Rules is deleted and the following rule substituted therefor:
Appeal by holder of foreign driving licence
8.—(1)  The holder of a foreign driving licence may, if aggrieved by the prohibition order made against him under rule 7, within 14 days of the receipt of the prohibition order, appeal to the Minister whose decision shall be final.
(2)  The Minister may, after taking into consideration such facts in mitigation as may be submitted by the holder of a foreign driving licence, rescind the prohibition order or shorten the effective period of that prohibition order.”.
Amendment of rule 9
7.  Rule 9 of the principal Rules is amended —
(a)by deleting the words “a foreign motorist” in paragraph (1) and substituting the words “the holder of a foreign driving licence”;
(b)by deleting the words “the foreign motorist” in paragraph (2) and substituting the words “the holder of a foreign driving licence”; and
(c)by deleting the words “the foreign motorist’s” in paragraph (2) and substituting the word “his”.
Amendment of Schedule
8.  The Schedule to the principal Rules is amended —
(a)by inserting, immediately after the words “police officer” in item (5), the words “, employee of Authority or security officer engaged in regulating traffic”;
(b)by deleting item (6);
(c)by deleting the words “[Rules 7(1)(l) and 7(11), Road Traffic (Traffic Signs) Rules]” in item (12) and substituting the words “[Section 120(3) of the Act read with rule 7(1)(m) and (12), Road Traffic (Traffic Signs) Rules]”;
(d)by deleting the words “Load falling from vehicle” in item (21) and substituting the words “Failing to securely tie or attach goods to a goods vehicle to prevent their falling off from the vehicle”;
(e)by deleting item (24) and substituting the following item:
(24) Driving or riding against the flow of traffic as indicated by traffic signs [Section 120(3) of the Act]

(f)by deleting the words “Section 120(1)(b)” in item (26) and substituting the words “Section 120(3)”.
