Insolvency, Restructuring and Dissolution
(Miscellaneous Amendments) Rules 2020

In exercise of the powers conferred by section 448 of the Insolvency, Restructuring and Dissolution Act 2018, we, the Rules Committee, make the following Rules:

Citation and commencement

1. These Rules are the Insolvency, Restructuring and Dissolution (Miscellaneous Amendments) Rules 2020 and come into operation on 2 January 2021.

Amendment of Insolvency, Restructuring and Dissolution (Personal Insolvency) Rules 2020

2. The Insolvency, Restructuring and Dissolution (Personal Insolvency) Rules 2020 (G.N. No. S 585/2020) are amended —

(a)

by deleting the words “High Court” wherever they appear in the following provisions and substituting in each case the words “General Division of the High Court”:

Rule 2(1) (definition of “Court”)

Rule 3(a)

Rule 24(2) and (3)

Rule 29

Rule 41

Rule 157

First Schedule, Forms PIR-2, PIR-3, PIR‑9, PIR‑11, PIR‑12, PIR-20 and PIR-24; and

(b)

by deleting the words “High Court” in the following provision and substituting the words “Supreme Court”:

Amendment of Insolvency, Restructuring and Dissolution (Corporate Insolvency and Restructuring) Rules 2020

3. The Insolvency, Restructuring and Dissolution (Corporate Insolvency and Restructuring) Rules 2020 (G.N. No. S 603/2020) are amended —

(a)

by deleting the words “High Court” in the following provisions and substituting in each case the words “General Division of the High Court”:

Rule 2(1) (definition of “Court”)

Rule 3(a)

Rule 22(2) and (3)

Rule 27

Rule 37

Rule 180(3)

First Schedule, Form CIR‑5; and

(b)

by deleting the words “HIGH COURT” in the following provisions and substituting in each case the words “GENERAL DIVISION OF THE HIGH COURT”:

First Schedule, Forms CIR-3, CIR‑11 and CIR‑12.
