Optometrists and Opticians
(Exemption from section 25(1)) (Amendment)
Order 2014
In exercise of the powers conferred by section 35(1) of the Optometrists and Opticians Act, the Minister for Health hereby makes the following Order:
Citation and commencement
1.  This Order may be cited as the Optometrists and Opticians (Exemption from section 25(1)) (Amendment) Order 2014 and shall come into operation on 15 August 2014.
Deletion and substitution of paragraph 3
2.  Paragraph 3 of the Optometrists and Opticians (Exemption from section 25(1)) Order (O 1) is deleted and the following paragraph substituted therefor:
Exemption of orthoptists
3.  An individual who holds a degree in orthoptics or such equivalent qualification as the Board may approve in any particular case, is exempted from section 25(1) of the Act in relation to the performance by the individual of refraction, and of binocular vision tests and visual field tests to detect abnormalities of the eye of a patient if —
(a)for an individual who obtained that degree prior to 1 January 2008, he performs the refraction, binocular vision tests and visual field tests under the supervision of an ophthalmologist or on an ophthalmologist’s patient upon a referral from the ophthalmologist; or
(b)for an individual who obtained that degree on or after 1 January 2008 —
(i)he holds, in addition, any qualification specified in the Schedule or such equivalent qualification as the Board may approve in any particular case; and
(ii)he performs the refraction, binocular vision tests and visual field tests under the supervision of an ophthalmologist or on an ophthalmologist’s patient upon a referral from the ophthalmologist.”.

3.  The Optometrists and Opticians (Exemption from section 25(1)) Order is amended by inserting, immediately after paragraph 8, the following Schedule:
