Optometrists and Opticians
(Registration and Practising Certificates)
(Amendment) Regulations 2020
In exercise of the powers conferred by section 37 of the Optometrists and Opticians Act, the Minister for Health, after consulting the Optometrists and Opticians Board, makes the following Regulations:
Citation and commencement
1.  These Regulations are the Optometrists and Opticians (Registration and Practising Certificates) (Amendment) Regulations 2020 and come into operation on 20 November 2020.
Amendment of Part II of First Schedule
2.  Item 1 of Part II of the First Schedule to the Optometrists and Opticians (Registration and Practising Certificates) Regulations (Rg 1) is amended by deleting the word “(Part‑Time)” under the heading “Qualification”.
Amendment of Part II of Second Schedule
3.  Part II of the Second Schedule to the Optometrists and Opticians (Registration and Practising Certificates) Regulations is amended —
(a)by deleting item 1 relating to the region “Hong Kong”;
(b)by deleting the words “The City University, London” under the heading “Body Granting Qualification” in item 3 relating to the country “United Kingdom” and substituting the words “City, University of London”;
(c)by deleting the words “Masters in Optometry” under the heading “Qualification” in item 5 relating to the country “United Kingdom” and substituting the words “Master of Science in Optometry”;
(d)by deleting the words “University of Wales, Cardiff” under the heading “Body Granting Qualification” in item 8 relating to the country “United Kingdom” and substituting the words “Cardiff University”;
(e)by deleting item 1 relating to the country “Republic of Ireland”;
(f)by deleting the words “Dublin Institute of Technology” under the heading “Body Granting Qualification” in item 2 relating to the country “Republic of Ireland” and substituting the words “Technological University Dublin”;
(g)by deleting the word “, Boston” under the heading “Body Granting Qualification” in item 4 relating to the country “United States of America”;
(h)by deleting the word “, Philadelphia” under the heading “Body Granting Qualification” in item 7 relating to the country “United States of America” and substituting the words “at Salus University”;
(i)by deleting the words “Southern California College of Optometry” under the heading “Body Granting Qualification” in item 8 relating to the country “United States of America” and substituting the words “Southern California School of Optometry at Marshall B. Ketchum University”;
(j)by deleting the word “, Memphis” under the heading “Body Granting Qualification” in item 9 relating to the country “United States of America”;
(k)by deleting item 11 relating to the country “United States of America”; and
(l)by deleting the words “, College of Optometry” under the heading “Body Granting Qualification” in item 12 relating to the country “United States of America”.
Saving and transitional provisions
4.—(1)  Despite regulation 2, Part II of the First Schedule to the Optometrists and Opticians (Registration and Practising Certificates) Regulations as in force immediately before 20 November 2020 continues to apply to a person who, before that date, has commenced, or secured a place as a candidate for, the course of study conducted by the Ontario Colleges of Applied Arts and Technology (Seneca College) that leads to the conferment, on or after that date, of the qualification “Opticianry Diploma (Part‑Time)”, as if these Regulations had not been made.
(2)  Despite regulation 3, Part II of the Second Schedule to the Optometrists and Opticians (Registration and Practising Certificates) Regulations as in force immediately before 20 November 2020 continues to apply to a person who, before that date, has commenced, or secured a place as a candidate for, a course of study conducted by any of the foreign institutions specified in that Part that leads to the conferment, on or after that date, of an approved foreign qualification in optometry that corresponds to that foreign institution, as if these Regulations had not been made.
(3)  To avoid doubt, nothing in regulations 2 and 3 affects any person who, before 20 November 2020, has been conferred an approved foreign qualification in opticianry or an approved foreign qualification in optometry under the Optometrists and Opticians (Registration and Practising Certificates) Regulations in force before that date.
