Building Control Act
(Chapter 29)
Building Control (Buildable Design) (Amendment) Regulations 2005
In exercise of the powers conferred by section 49 of the Building Control Act, the Minister for National Development hereby makes the following Regulations:
Citation and commencement
1.  These Regulations may be cited as the Building Control (Buildable Design) (Amendment) Regulations 2005 and shall come into operation on 1st September 2005.
Amendment of regulation 3
2.  Regulation 3 of the Building Control (Buildable Design) Regulations (Rg 8) is amended by deleting paragraph (2) and substituting the following paragraph:
(2)  These Regulations shall not apply to building works consisting of repairs, alterations or additions to an existing building (whether carried out within or outside the existing building) unless —
(a)in the case of building works for which an application for planning permission is submitted on or after 1st January 2001 but before 1st January 2004, the building works involve increasing the gross floor area of the existing building by 5,000 square metres or more;
(b)in the case of building works for which an application for planning permission is submitted on or after 1st January 2004 but before 1st September 2005, the building works involve increasing the gross floor area of the existing building by 2,000 square metres or more; and
(c)in the case of building works for which an application for planning permission is submitted on or after 1st September 2005 —
(i)the gross floor area of the existing floor to be reconstructed;
(ii)the increase in the gross floor area of the existing building that will result from the building works; or
(iii)the sum of sub-paragraphs (i) and (ii),
is 2,000 square metres or more.”.
Amendment of regulation 4
3.  Regulation 4 of the Building Control (Buildable Design) Regulations is amended by deleting paragraphs (a) and (b) and substituting the following paragraphs:
(a)the minimum buildability score for the relevant category of building works as set out according to type of use in the Code of Practice and, in the case of building works consisting of mixed categories of building works, the sum of the minimum buildability scores for each of the categories pro-rated in proportion to the percentage of gross floor area used for that category; and
(b)the minimum buildability score for the relevant type of building works as set out in the Code of Practice and, in the case of building works consisting of repairs, alterations or additions to an existing building which are carried out both within and outside the existing building, the sum of the minimum buildability scores for each type of building works pro-rated in proportion to the percentage of gross floor area involved for that type of building works.”.
