Family Justice Act 2014

Family Justice (Amendment No. 3) Rules 2019
In exercise of the powers conferred by section 46 of the Family Justice Act 2014 and all other powers enabling us under any written law, we, the Family Justice Rules Committee, make the following Rules:
Citation and commencement
1.  These Rules are the Family Justice (Amendment No. 3) Rules 2019 and come into operation on 29 November 2019.
Amendment of rule 38
2.  Rule 38(1) of the Family Justice Rules 2014 (G.N. No. S 813/2014) (called in these Rules the principal Rules) is amended by deleting the definition of “HDB standard query”.
Amendment of rule 40
3.  Rule 40 of the principal Rules is amended —
(a)by inserting, immediately after the words “made by” in paragraph (1), the words “ex parte”;
(b)by inserting, immediately after the words “file the” in paragraph (2), the words “ex parte”;
(c)by deleting the words “originating summons must” in paragraph (4) and substituting the words “ex parte originating summons may”; and
(d)by deleting paragraphs (5) and (6).
Amendment of rule 46
4.  Rule 46 of the principal Rules is amended —
(a)by deleting paragraph (4) and substituting the following paragraph:
(4)  Before the filing of a proposed matrimonial property plan under paragraph (1), the plaintiff must obtain his relevant CPF statement and any additional CPF information, in the relevant Form and within the time specified by the Registrar.”; and
(b)by deleting the words “or (4)” in paragraph (6)(b).
Amendment of rule 938
5.  Rule 938 of the principal Rules is amended by inserting, immediately after paragraph (2), the following paragraph:
(2A)  Where the Minister considers that the letter of request does not comply with paragraph (1) or (2), the Minister must inform the requesting court or tribunal of —
(a)the non‑compliance; and
(b)the provisions that must be complied with before the request may be further considered.”.
