Air Navigation Act
(Chapter 6)
Air Navigation (Investigation of Accidents and Incidents) (Amendment) Order 2009
In exercise of the powers conferred by section 3(1) of the Air Navigation Act, the Minister for Transport hereby makes the following Order:
Citation and commencement
1.  This Order may be cited as the Air Navigation (Investigation of Accidents and Incidents) (Amendment) Order 2009 and shall come into operation on 25th May 2009.
Amendment of paragraph 3
2.  Paragraph 3(3) of the Air Navigation (Investigation of Accidents and Incidents) Order (O 7) (referred to in this Order as the principal Order) is amended by deleting the words “in the case of an accident,” in sub-paragraph (d).
Amendment of paragraph 4
3.  Paragraph 4(4) of the principal Order is amended —
(a)by deleting the word “or” at the end of sub-paragraph (a); and
(b)by deleting the full-stop at the end of sub-paragraph (b) and substituting a semi-colon, and by inserting immediately thereafter the following sub-paragraphs:
(c)where the accident or serious incident occurs in Singapore airspace, the ATS provider; or
(d)where the accident or serious incident occurs during a flying display in Singapore, the organiser of the flying display.”.
Amendment of paragraph 11
4.  Paragraph 11 of the principal Order is amended by deleting sub-paragraph (4) and substituting the following sub-paragraph:
(4)  The investigator-in-charge shall allow a Contracting State which has a special interest in an accident by virtue of fatalities or serious injuries to its citizens to appoint an expert to participate in the investigation if the Contracting State so requests.”.
Amendment of paragraph 14
5.  Paragraph 14 of the principal Order is amended —
(a)by deleting the words “into an accident” in sub-paragraph (2);
(b)by deleting sub-paragraph (a) of sub-paragraph (2) and substituting the following sub-paragraph:
(a)send a copy of the draft Final Report to each of the following Contracting States, inviting their significant and substantiated comments on the draft Final Report:
(i)the Contracting State that instituted the investigation;
(ii)the Contracting States that participated in the investigation; and
(iii)the following Contracting States, whether or not they participated in the investigation:
(A)the State of Registry;
(B)the State of the Operator;
(C)the State of Design; and
(D)the State of Manufacture;”;
(c)by deleting the words “sub-paragraph (1)” in sub-paragraph (2)(c)(i) and substituting the words “sub-paragraph (a)”;
(d)by deleting the word “and” at the end of sub-paragraph (2)(c)(ii);
(e)by deleting sub-paragraph (iii) of sub-paragraph (2)(c) and substituting the following sub-paragraphs:
(iii)any Contracting State that provided relevant information, significant facilities or experts for the purposes of the investigation; and
(iv)where the accident or incident involves an aircraft of a maximum certificated take-off mass of more than 5,700 kg, the International Civil Aviation Organisation;”;
(f)by deleting the full-stop at the end of sub-paragraph (d) of sub-paragraph (2) and substituting the word “; and”, and by inserting immediately thereafter the following sub-paragraph:
(e)where the incident involves an aircraft of a maximum certificated take-off mass of more than 5,700 kg, send the Incident Data Report to the International Civil Aviation Organisation.”; and
(g)by deleting sub-paragraphs (3) and (5).
Amendment of paragraph 15
6.  Paragraph 15(1) of the principal Order is amended by deleting the words “, with the approval of the Minister,”.
