An Act to amend the Constitution of the Republic of Singapore (1992 Revised Edition).
Be it enacted by the President with the advice and consent of the Parliament of Singapore, as follows:
Short title and commencement
1.—(1)  This Act may be cited as the Constitution of the Republic of Singapore (Amendment) Act 1998 and shall come into operation on such date as the President may, by notification in the Gazette, appoint.
(2)  The President may appoint different dates for the coming into operation of the different provisions of this Act.
Amendment of Article 22
2.  Article 22(1) of the Constitution of the Republic of Singapore (referred to in this Act as the Constitution) is amended by deleting paragraph (g) and substituting the following paragraph:
(g)the Chief Valuer;”.
Amendment of Article 103
3.  Article 103(b) of the Constitution is amended by deleting the words ", the Legal Service Commission, the Education Service Commission or the Police and Civil Defence Services Commission" in sub-paragraph (iv) and substituting the words "or the Legal Service Commission".
Repeal of Articles 110A, 110B and 110C
4.  Articles 110A, 110B and 110C of the Constitution are repealed.
Amendment of Article 110D
5.  Article 110D of the Constitution is amended —
(a)by deleting the words ", the Education Service Commission and the Police and Civil Defence Services Commission in respect of the public officers each Commission has charge of under Articles 110, 110A and 110B, respectively" in clause (1) and substituting the words "under Article 110";
(b)by deleting the words "a Commission referred to in that clause" in the fourth and fifth lines of clause (3) and substituting the words "the Public Service Commission";
(c)by deleting the words "Articles 110(1) and (4), 110A(2) and 110B(2)" in clause (3)(a) and substituting the words "Article 110(1) and (4)";
(d)by deleting the words "the Commission referred to in clause (1) which would have exercised the powers of that personnel board if this Article had not been enacted" in clause (4) and substituting the words "the Public Service Commission";
(e)by deleting the words "any such" in the eighth line of clause (4) and substituting the word "the";
(f)by deleting the words "a Commission" at the end of clause (7)(d) and substituting the words "the Public Service Commission"; and
(g)by deleting the words "the Education Service Commission, the Police and Civil Defence Services Commission or the Public Service Commission under Article 110C(2) or 116(3), as the case may be" in clause (8) and substituting the words "the Public Service Commission under Article 116(3)".
Amendment of Article 113
6.  Article 113 of the Constitution is amended by deleting the words ", the Education Service Commission, the Police and Civil Defence Services Commission" in clauses (1) and (2) and in the marginal note.
Amendment of Article 114
7.  The Constitution is amended by renumbering Article 114 as clause (1) of that Article, and by inserting immediately thereafter the following clause:
(2)  Notwithstanding clause (1), the Legislature may by law provide that any pension, gratuity or other allowance granted in respect of public service otherwise than in a civil capacity may be paid out of another Government Fund in lieu of the Pension Fund and the Consolidated Fund.”.
Amendment of Article 148F
8.  Article 148F(3) of the Constitution is amended by deleting the words ", the Education Service Commission, the Police and Civil Defence Services Commission".
Savings and Transitional
9.—(1)  Notwithstanding section 4, where on the commencement of that section there are pending —
(a)any disciplinary proceedings against any public officer in the Education Service of the Singapore Civil Service or any public officer in the Singapore Police Force, the Singapore Civil Defence Force or any other services designated as part of either Force pursuant to Article 110D(4); or
(b)any appeal to the Education Service Commission or the Police and Civil Defence Services Commission by any such officer,
the proceedings shall be carried out and completed or the appeal shall be heard and decided upon by the Public Service Commission; but where on such commencement any disciplinary matter was in the course of being heard or investigated or had been heard or investigated by a committee acting under due authority but no order or decision had been rendered thereon, the committee shall complete the hearing or investigation and make such order or report as it could have made or given under the authority vested in it before the commencement of section 4.
(2)  Any order or report made or given by a committee under subsection (1) shall be treated as an order or report to the Public Service Commission.
