Environmental Public Health Act
(Chapter 95)
Environmental Public Health (Composition of Offences) (Amendment) Rules 2009
In exercise of the powers conferred by section 104(3) of the Environmental Public Health Act, the National Environment Agency, with the approval of the Minister for the Environment and Water Resources, hereby makes the following Rules:
Citation and commencement
1.  These Rules may be cited as the Environmental Public Health (Composition of Offences) (Amendment) Rules 2009 and shall come into operation on 1st July 2009.
Amendment of rule 2
2.  Rule 2 of the Environmental Public Health (Composition of Offences) Rules (R 1) is amended by inserting, immediately after paragraph (g), the following paragraph:
“(ga)any offence under —
(i)regulation 41 of the Environmental Public Health (Toxic Industrial Waste) Regulations (Rg 11) for contravening regulation 4, 5, 6, 8, 10, 11, 12, 13(4), 15, 16, 17, 19, 21, 22, 23, 24, 25, 26, 27, 28, 29, 30, 31, 32, 34, 35, 38(1) or 39(2) of those Regulations; and
(ii)section 85(1) of the Act in relation to a notice given under regulation 38(2) or 39(1) of the Environmental Public Health (Toxic Industrial Waste) Regulations;”.
