Environmental Protection and Management Act
(Chapter 94A)
Environmental Protection and Management (Vehicular Emissions) (Amendment) Regulations 2010
In exercise of the powers conferred by section 77(1) of the Environmental Protection and Management Act, the National Environment Agency, with the approval of the Minister for the Environment and Water Resources, hereby makes the following Regulations:
Citation and commencement
1.—(1)  These Regulations may be cited as the Environmental Protection and Management (Vehicular Emissions) (Amendment) Regulations 2010 and shall, with the exception of regulations 2, 4, 5, 7, 8 and 9, come into operation on 1st October 2010.
(2)  Regulations 2, 4, 5, 7, 8 and 9 shall come into operation on 1st April 2011.
Amendment of regulation 2
2.  Regulation 2 of the Environmental Protection and Management (Vehicular Emissions) Regulations (Rg 6) (referred to in these Regulations as the principal Regulations) is amended by deleting the definition of “registered” and substituting the following definitions:
“ “registered elsewhere”, in relation to a motor vehicle, means registered for the first time under the provisions of any law of any country (other than Singapore) relating to motor vehicles;
“registered in Singapore”, in relation to a motor vehicle, means registered for the first time under section 26 of the Road Traffic Act (Cap. 276);”.
Amendment of regulation 5
3.  Regulation 5 of the principal Regulations is amended by deleting the words “1st July 1999” and substituting the words “1st October 2010”.
Deletion and substitution of regulation 7
4.  Regulation 7 of the principal Regulations is deleted and the following regulation substituted therefor:
Standards for noise emission for in-use motor vehicles
7.—(1)  Except as provided in paragraph (2), every motor vehicle that is in use (whether or not registered in Singapore or elsewhere) shall conform to the standard of noise emission specified in the Sixth Schedule for the class of motor vehicle to which that motor vehicle belongs.
(2)  Every licensed motor vehicle that is in use shall conform to the standard of noise emission specified in the Seventh Schedule for the class of motor vehicle to which that motor vehicle belongs if the motor vehicle was registered in Singapore or elsewhere before 1st July 1999.”.
Amendment of regulation 20
5.  Regulation 20 of the principal Regulations is amended by deleting paragraph (1) and substituting the following paragraph:
(1)  No person shall use or cause or permit to be used on a road any motor vehicle that does not conform to the standard for noise emission specified under regulation 7 for the class of motor vehicle to which that motor vehicle belongs.”.
Deletion and substitution of Fourth Schedule
6.  The Fourth Schedule to the principal Regulations is deleted and the following Schedule substituted therefor:

Regulation 5
Standard for Noise Emission for New Motor Vehicles
Motor vehicles of the following classes shall not emit any noise exceeding the noise level specified in the second column when measured 0.5 metre from the open end of the exhaust pipe of the vehicle or shall conform to the standards for exhaust noise emission specified in the third column:

7.  The principal Regulations are amended by inserting, immediately after the Fifth Schedule, the following Schedule:

Amendment of Sixth Schedule
8.  The existing Sixth Schedule to the principal Regulations is amended —
(a)by renaming the Sixth Schedule as the Seventh Schedule;
(b)by deleting the Schedule reference and substituting the following Schedule reference:
Regulation 7(2)”;
(c)by deleting the Schedule heading and substituting the following Schedule heading:

BEFORE 1ST JULY 1999”;
(d)by deleting the words “following levels specified” in paragraph 1 and substituting the words “noise level specified in this Schedule”; and
(e)by inserting, immediately after the word “registered” in paragraph 2(a) and (b), the words “in Singapore”.
Miscellaneous amendments
9.  The principal Regulations are amended —
(a)by inserting, immediately after the word “registered” wherever it appears in the following provisions, the words “in Singapore”:
Regulations 4(1) to (4), 5, 6 (1st line), 8, 9 and 21A(5)(b) and regulation 3(a) to (d) of the Fifth Schedule;
(b)by inserting, immediately after the word “ registered” in the headings of Parts I and II of the Second Schedule, the words “in Singapore”; and
(c)by deleting the word “tonnes” wherever it appears in the Second Schedule and substituting the word “tons”.
