Animal and Bird Shop, Poultry Shop and Hatchery (Licensing and Control) Rules

Citation
1.  These Rules may be cited as the Animal and Bird Shop, Poultry Shop and Hatchery (Licensing and Control) Rules.
Definition
2.  In these Rules, “ Licensing Officer” means the Director of Primary Production, and includes any officer duly authorised by him in writing.
Licence
3.  No place shall be used for keeping in captivity any animal for sale, export or exhibition except under licence issued by the Licensing Officer.
Fees
4.—(1)  The fees for the issue of licences shall be as follows:
(a) Animal and bird shop:
 
(i) for a period not exceeding one year;
$120; or
(ii) for a period exceeding two years but not exceeding 3 years
$360
(b) Aquarium fish shop:
 
(i) for a period not exceeding one year
$ 70; or
(ii) for a period exceeding two years but not exceeding 3 years
$210
(c) Poultry shop:
 
(i) for a period not exceeding one year
$120; or
(ii) for a period exceeding two years but not exceeding 3 years
$360
(d) Hatchery:
 
(i) for a period not exceeding one year
$125; or
(ii) for a period exceeding two years but not exceeding 3 years
$375
(e) Exhibition of animals or birds:
 
(i) for a period not exceeding 7 days
$ 30;
(ii) for a period exceeding 7 days but not exceeding one year
$120; or
(iii) for a period exceeding two years but not exceeding 3 years.
$360.
(2)  In this rule, “ shop” means any place where any animal, bird or aquarium fish is kept in captivity for sale, export or exhibition.
Application for licence
5.—(1)  Every application for a licence shall be made in such form as may be prescribed by the Licensing Officer.
(2)  The Licensing Officer may, after inspection of the premises, in his discretion, issue a licence for the premises.
Validity of licence
6.  A licence may be issued for a period of one year or 3 years.
Licence to be exhibited
7.  A person to whom a licence is issued under these Rules shall cause it to be kept exhibited in a conspicuous place in the licensed premises.
Conditions of licence
8.  Every licence shall be subject to —
(a)the requirements relating to the standard sizes of cages and minimum floor space in respect of the classes of animals set out in the Schedule; and
(b)such conditions as the Licensing Officer may in his discretion think fit to impose.
Penalty
9.—(1)  Any person who contravenes or fails to comply with rule 3 or 7 or any of the conditions subject to which a licence is issued under these Rules shall be guilty of an offence and shall be liable on conviction to a fine not exceeding $500.
(2)  The Licensing Officer may compound any offence under these Rules by accepting from a person reasonably suspected of having committed the offence a sum not exceeding $50.
Revocation and suspension of licence
10.  The Licensing Officer may revoke or suspend any licence where —
(a)the licensee is convicted of an offence under the Act or under these Rules; or
(b)the licensee fails to comply with any of the requirements of the Schedule.
Inspection
11.  For the purposes of inspection the Licensing Officer shall at all reasonable times have free access to and from any part of any premises licensed under these Rules.
Exemption
12.  The Licensing Officer may in his discretion exempt any person, society or organisation from all or any of the provisions of these Rules.
