(Employment of Environmental Control Officers) Order

Citation
1.  This Order may be cited as the Environmental Public Health (Employment of Environmental Control Officers) Order.
Definitions
2.  In this Order —
“contract sum”, in relation to a construction site, means the total value of the works to be carried out on the construction site as stated in the applicable contract;
“works”, in relation to a construction site, means —
(a)the erection, construction, alteration, repair or maintenance of buildings, structures or roads;
(b)the breaking up or opening of, or boring under, any road or adjacent land in connection with the construction, inspection, maintenance or removal of works;
(c)demolition or dredging works; or
(d)any other work of engineering construction.
Application of this Order
3.  This Order shall apply to any construction site the contract sum in relation to which exceeds $10 million.
Employment of Environmental Control Officer
4.—(1)  Where the contract sum in relation to a construction site exceeds $50 million, the occupier of the construction site shall employ a competent person to act as an Environmental Control Officer in the construction site on a full-time basis.
(2)  Where the contract sum in relation to a construction site exceeds $10 million but does not exceed $50 million, the occupier of the construction site shall employ a competent person to act as an Environmental Control Officer in the construction site on a part-time basis.
Full-time and part-time basis
5.—(1)  An Environmental Control Officer employed on a full-time basis under paragraph 4(1) shall act as an Environmental Control Officer in the construction site for which he is employed for at least 40 hours per week.
(2)  An Environmental Control Officer employed on a part-time basis under paragraph 4(2) shall act as an Environmental Control Officer in the construction site for which he is employed for at least 15 hours per week.
