IMPORT, MANUFACTURE AND SALE OF TELECOMMUNICATION EQUIPMENT
Restrictions on importation of telecommunication equipment
20.—(1) Notwithstanding the grant of a Telecommunication Dealer’s Licence, no person shall import any telecommunication equipment without the prior approval of the Authority.
(2) No approval shall be granted by the Authority under paragraph (1) for the import of any telecommunication equipment set out in the First Schedule .
(3) A person applying for approval under paragraph (1) shall furnish such particulars as may be required by the Authority and shall have his inward declaration under the Registration of Imports and Exports Rules for the equipment endorsed by the Authority before such equipment is brought into Singapore.

(4) No person shall —
(a)
furnish false or misleading information to the Authority for the purpose of obtaining the approval of the Authority under paragraph (1); or
(b)
falsify or fabricate any decision that the Authority may make upon the application for approval under paragraph (1).
(5) Any person who furnishes any false or misleading information to the Authority for the purpose of obtaining the approval of the Authority or falsifies or fabricates any decision that the Authority may make upon the application for approval shall render the approval null and void.
Power of Authority to order production of equipment
21. The Authority may direct that any telecommunication equipment that is imported be produced by the dealer for testing or inspection by the Authority and all expenses incurred in connection therewith shall be borne by the dealer.
Equipment imported for re-export
22. Any dealer who imports any telecommunication equipment into Singapore for the purpose of re-export shall —
(a)
unless the Authority otherwise directs, immediately move the telecommunication equipment into a free trade zone under the Free Trade Zones Act [Cap. 114] and keep it there pending re-export; and
(b)
re-export the telecommunication equipment and furnish satisfactory evidence of the re-export to the Authority within such period of time as may be stipulated by the Authority.
Equipment declared for export
22A. Any dealer who imports any telecommunication equipment into Singapore declaring it to be for export shall not, except with the approval of the Authority, sell it to any person for use in Singapore.

Restrictions on manufacture and sale of telecommunication equipment
23. Notwithstanding the grant of any Telecommunication Dealer’s Licence, no person shall manufacture, sell or possess for sale —
(a)
any telecommunication equipment set out in the First Schedule; or
(b)
any telecommunication equipment which does not meet the standards or specifications published by the Authority from time to time.
Dealers to sell type-approved equipment only
24.—(1) No dealer shall sell any telecommunication equipment to any person for use in Singapore unless the telecommunication equipment or type of telecommunication equipment has been approved by the Authority to be used for connection to any telecommunication system or equipment belonging to a public telecommunication licensee under section 30 of the Act.
(2) The fees for an application by a dealer for approval of telecommunication equipment or a type of telecommunication equipment to be used for connection to any telecommunication system or equipment belonging to a public telecommunication licensee under section 30 of the Act are set out in the Second Schedule.
Particulars of equipment to be sold
25. A dealer shall furnish the Authority with such detailed specifications and information on the types of telecommunication equipment manufactured, sold or to be manufactured or sold by him as the Authority may, from time to time, specify.
Licensee to give written undertaking
26. Where a dealer intends to manufacture or import any telecommunication equipment for export only, the Authority may require the dealer to give a written undertaking that the equipment will not be sold, offered or possessed for sale in Singapore.
Power to order disposal of equipment
27. Where any person —
(a)
imports any telecommunication equipment without the approval of the Authority; or
(b)
manufactures, sells, offers or possesses for sale any telecommunication equipment which does not meet the standards or specifications published by the Authority from time to time,
the Authority may direct that person to dispose of the equipment in any manner which the Authority, in its discretion, thinks fit at the licensee’s expense.
Display of licence, approval labels, etc.
28.—(1) A dealer shall —
(a)
exhibit his Telecommunication Dealer’s Licence at all times in a prominent position at each place of his business;
(b)
affix or ensure that there is affixed on all type-approved equipment intended for use in Singapore such type-approval labels provided by the Authority before such equipment is put on display or offered for sale;
(c)
affix or ensure that there is affixed on any telecommunication equipment sold in Singapore such other labels as the Authority considers necessary before such equipment is put on display or offered for sale; and
(d)
ensure that every advertisement, pamphlet or brochure relating to any telecommunication equipment which he sells or offers for sale contains such information as the Authority may specify.
(2) A dealer shall display equipment which has been type-approved by the Authority separately from equipment the type of which has not been approved at each place of his business.
(3) Where any telecommunication equipment the type of which has not been approved by the Authority under regulation 24 is sold or displayed, the dealer shall, at all times and in prominent positions at the premises where the equipment is sold or displayed, exhibit such signs or notices as the Authority may require.
(4) The dealer shall not affix any type-approval label provided by the Authority on any telecommunication equipment the type of which has not been approved by the Authority.
(5) A dealer shall comply with such rules of labelling as the Authority may publish from time to time.
Records
29.—(1) A dealer shall maintain a record of every sale of any type of telecommunication equipment which the Authority may, from time to time, specify.
(2) The record shall contain such information, be kept in such form and be submitted to the Authority at such intervals as the Authority may, from time to time, determine.
(3) Every purchaser or hirer of telecommunication equipment shall furnish to the dealer upon request, his name, identity card number and address.
(4) The dealer shall submit the particulars recorded under paragraph (1) at such intervals and in such format as the Authority may specify.
(5) The dealer shall, at all reasonable times, permit an authorised officer to inspect and make copies of any entry in the record kept under paragraph (1).
Duty to inform purchasers and hirers of licensing requirements
30. The dealer shall inform every purchaser or hirer to whom he sells or lets any telecommunication equipment of the need to obtain a licence from the Authority if the purchaser or hirer is required under the Act or any regulations made thereunder to obtain any licence for the possession, operation, installation or use of that equipment.
