Employment Claims Rules 2017
In exercise of the powers conferred by section 33 of the Employment Claims Act 2016, we, the Rules Committee, make the following Rules:
PART 1
PRELIMINARY
Citation and commencement
1.  These Rules are the Employment Claims Rules 2017 and come into operation on 1 April 2017.
Application of Rules
2.—(1)  These Rules apply to —
(a)all proceedings under Part 3 of the Act; and
(b)every application to a District Court under section 7(2) or (4) of the Act.
(2)  Subject to paragraph (3), the Rules of Court (Cap. 322, R 5) do not apply to the following:
(a)any proceedings before a tribunal or the Registrar;
(b)any procedure for proceedings in the High Court (arising from an order of a tribunal) for which provision is made in these Rules (such as the procedure for an appeal to the High Court against an order of a tribunal).
(3)  Order 46, Rule 11 (read with Order 52, Rule 9(4)) and Order 52 of the Rules of Court apply to committal proceedings before a tribunal.
Forms
3.—(1)  In these Rules, “relevant Form”, in relation to any purpose for which a specific form is required to be used, means the current version of the specific form for that purpose set out in the practice directions issued by the registrar of the State Courts.
(2)  The forms set out in the practice directions may be used with such variations as the circumstances of any particular case require.
