(Amendment No. 5) Regulations 2021

In exercise of the powers conferred by section 73 of the Infectious Diseases Act, the Minister for Health makes the following Regulations:

Citation and commencement

1. These Regulations are the Infectious Diseases (Antigen Rapid Test Providers) (Amendment No. 5) Regulations 2021 and come into operation on 3 January 2022.

Amendment of regulation 2

2. Regulation 2(1) of the Infectious Diseases (Antigen Rapid Test Providers) Regulations 2021 (G.N. No. S 267/2021) (called in these Regulations the principal Regulations) is amended —

(a)

by inserting, immediately after the words “holding any” in the definition of “Class A test provider”, the words “HCSA licence or”; and

(b)

by inserting, immediately after the definition of “Class A test provider”, the following definition:

“ “HCSA licence” means a licence issued under the Healthcare Services Act 2020 and in force;”.

Amendment of regulation 5

3. Regulation 5(2) of the principal Regulations is amended —

(a)	by deleting the words “a PHMCA licence” in sub‑paragraph (f) and substituting the words “an HCSA licence or a PHMCA licence, as the case may be”; and
(b)	by inserting, immediately after the words “subject of” in sub‑paragraph (h), the words “an HCSA licence or”.

Amendment of regulation 6

4. Regulation 6 of the principal Regulations is amended —

(a)	by inserting, immediately after the word “holds” in paragraph (1)(a), the words “an HCSA licence or”;
(b)	by inserting, immediately after the words “of the” in paragraph (1)(b), the words “HCSA licence or”; and
(c)	by inserting, immediately after the words “subject to” in paragraph (2)(b), the words “an HCSA licence or”.

Amendment of regulation 7

5. Regulation 7(1) of the principal Regulations is amended by inserting, immediately after the word “holds” in sub‑paragraph (f), the words “an HCSA licence or”.

Amendment of regulation 8

6. Regulation 8(1) of the principal Regulations is amended by inserting, immediately after the word “any” in sub‑paragraph (a), the words “HCSA licence or”.

Amendment of regulation 9

7. Regulation 9 of the principal Regulations is amended by deleting the words “non-PHMCA licence premises” in the regulation heading and substituting the words “premises not subject to HCSA or PHMCA licence”.
