Organised Crime
(Amendment) Regulations 2020
In exercise of the powers conferred by section 81 of the Organised Crime Act 2015, the Minister for Home Affairs makes the following Regulations:
Citation and commencement
1.  These Regulations are the Organised Crime (Amendment) Regulations 2020 and come into operation on 2 January 2021.
Amendment of regulation 2
2.  In regulation 2 of the Organised Crime Regulations 2016 (G.N. No. S 236/2016) (called in these Regulations the principal Regulations), after the definition of “decision of the original court”, insert:
“ “Judge” means a Supreme Court Judge, a Judicial Commissioner or a Senior Judge sitting in the General Division of the High Court in accordance with the Constitution and the Supreme Court of Judicature Act (Cap. 322);
“Judge sitting in the Court of Appeal” means a Supreme Court Judge, a Judicial Commissioner or a Senior Judge sitting in the Court of Appeal in accordance with the Constitution and the Supreme Court of Judicature Act;”.
Amendment of regulation 9
3.—(1)  In regulation 9(1) of the principal Regulations, replace “a Judge or a presiding Judge, as the case may be” with “a Judge (where the appellate court is the General Division of the High Court constituted by a single Judge), a presiding Judge (where the appellate court is the General Division of the High Court constituted by 3 or more Judges) or a presiding Judge sitting in the Court of Appeal (where the appellate court is the Court of Appeal)”.
(2)  In regulation 9(2) of the principal Regulations, replace “one Judge” with “one judge”.
(3)  In regulation 9(2) of the principal Regulations, replace “Judges of Appeal” with “Judges sitting in the Court of Appeal”.
(4)  In regulation 9(4) of the principal Regulations, replace “High Court Judge” with “Judge of the High Court”.
(5)  In regulation 9(4) of the principal Regulations, replace “to the High Court” with “to the General Division of the High Court”.
Amendment of regulation 11
4.—(1)  In the heading of regulation 11 of the principal Regulations, replace “Judges” with “judges”.
(2)  In regulation 11(2) of the principal Regulations, replace “Judges of Appeal” with “Judges sitting in the Court of Appeal”.
(3)  In regulation 11(2) of the principal Regulations, after “number of Judges”, insert “sitting in the Court of Appeal”.
(4)  In regulation 11(3) of the principal Regulations, replace “Judges” with “judges”.
(5)  In regulation 11(4)(b) of the principal Regulations, after “Judges”, insert “sitting in the Court of Appeal”.
Miscellaneous amendments
5.—(1)  In the principal Regulations, replace “High Court” in the following provisions with “General Division of the High Court”:
 Regulation 2 (definition of “decision of the original court”)
 Regulation 4(1)(a) and (3)
 Regulation 5(1)(a)
 Regulation 11(1) and (4)(a)
 Regulation 18(1)(l)
 Regulation 19(1)(f) and (h)
 The Schedule, Form 3.
(2)  In the principal Regulations, replace “HIGH COURT” in the following provisions with “GENERAL DIVISION OF THE HIGH COURT”:
 The Schedule, Forms 2 and 4.
