Road Traffic (TUM CREATE
Electric Three-Wheeled Motor Cycle Trial)
(Exemption) Order 2017
In exercise of the powers conferred by section 142 of the Road Traffic Act, the Minister for Transport makes the following Order:
Citation and commencement
1.—(1)  This Order is the Road Traffic (TUM CREATE Electric Three-Wheeled Motor Cycle Trial) (Exemption) Order 2017.
(2)  The period for which this Order is in force starts on 27 March 2017 and ends on 9 April 2017.
Definitions
2.  In this Order —
“prototype vehicle” means the electric three-wheeled motor cycle, developed by TUM CREATE, bearing the registration number FBL5361M;
“qualified person” means an individual who —
(a)holds a valid driving licence authorising the individual to drive a class 2B motor vehicle;
(b)has undergone training by TUM CREATE on how to operate the prototype vehicle; and
(c)is registered with, and authorised by, SingPost to operate the prototype vehicle;
“SingPost” means the company incorporated under the Companies Act (Cap. 50) under the name Singapore Post Limited (Registration No. 199201623M);
“specified area” means the area delineated in the Schedule;
“TUM CREATE” means the company incorporated under the Companies Act under the name TUM CREATE Limited (Registration No. 201013955Z).
Exemption
3.—(1)  Subject to sub-paragraph (2), the Road Traffic (Motor Vehicles, Construction and Use) Rules (R 9) do not apply to or in relation to the prototype vehicle, when it is used by any qualified person on a road within the specified area for or in connection with any test to assess the operational efficiency of the vehicle.
(2)  The exemption in sub-paragraph (1) is subject to the following conditions:
(a)when the prototype vehicle is in use on any road within the specified area, no other electric three-wheeled motor cycle developed by TUM CREATE is in use on any road within the specified area at the same time;
(b)there is in force, at all times when this Order is in force, a policy of insurance in relation to the use of the prototype vehicle by any person, insuring against any liability in respect of the death of or bodily injury sustained by, or property damage suffered by, any person caused by or arising out of the use of the prototype vehicle;
(c)the risk under the policy of insurance mentioned in sub‑paragraph (b) is assumed by an insurer who, at the time of issuance of the policy, is lawfully carrying on an insurance business in Singapore;
(d)there is in force, at all times when this Order is in force, a valid special purpose licence issued under section 28A(3) of the Act in respect of the prototype vehicle.
