Gas (Gas Importer’s Licence)
(Exemption) Order 2018
In exercise of the powers conferred by section 8 of the Gas Act, the Energy Market Authority of Singapore, with the approval of the Minister for Trade and Industry (Industry), makes the following Order:
Citation and commencement
1.—(1)  This Order is the Gas (Gas Importer’s Licence) (Exemption) Order 2018.
(2)  This Order is in force starting on 1 January 2018 and ending at 2359 hours on 28 January 2040.
Exemption
2.—(1)  Section 6(1)(h) of the Act does not apply to any person (not being an ineligible person) that —
(a)imports LNG;
(b)has, on the date of the import of the LNG, a contract with Singapore LNG Corporation Pte Ltd for a period commencing no later than that date and not exceeding 12 months (including any extension or renewal of the contract), for the storage and send-out of the LNG; and
(c)has not, in respect of any LNG previously imported by the person (but imported on or after 1 January 2018) and to which sub‑paragraph (b) applies, failed to consume or send out the LNG within 12 months after the date of import of that LNG.
(2)  For the purposes of sub‑paragraph (1), an ineligible person is —
(a)a person that holds a licence mentioned in section 7(3)(a), (b) or (f) of the Act;
(b)a person that holds a licence mentioned in section 7(3)(h) of the Act for importing LNG; or
(c)a person that holds a licence mentioned in section 9(1)(b), (ba), (e) or (g) of the Electricity Act (Cap. 89A).
