(COVID‑19 Clearance)
(Amendment No. 2) Regulations 2023
In exercise of the powers conferred by section 73(1) of the Infectious Diseases Act 1976, the Minister for Health makes the following Regulations:
Citation and commencement
1.  These Regulations are the Infectious Diseases (COVID‑19 Clearance) (Amendment No. 2) Regulations 2023 and come into operation on 1 April 2023.
Amendment of regulation 2
2.  In the Infectious Diseases (COVID‑19 Clearance) Regulations 2021 (G.N. No. S 273/2021) (called in these Regulations the principal Regulations), in regulation 2(1), in the definition of “cleared status certificate”, replace “6(2), (3), (4), (5) or (5A)” with “6(3), (4), (5), (5A) or (5B)”.
Amendment of regulation 6
3.  In the principal Regulations, in regulation 6 —
(a)delete paragraph (2);
(b)replace paragraphs (5) and (5A) with —
(5)  Despite paragraph (3) or (4), where an individual is assessed as having a COVID‑19 infection, after the individual underwent only a primary vaccination and was granted a certificate under that paragraph, the Director or a recognised medical practitioner may, where satisfied that the individual —
(a)is a recovered individual after that infection or any later infection; and
(b)has been administered another dose of any approved vaccine (whether before, on or after 1 June 2022) —
(i)at any time after the infection mentioned in sub‑paragraph (a); and
(ii)at least 86 days after the date the last dose of the primary vaccination was administered on the individual,
grant a certificate stating that the individual has a cleared status (general) for an indefinite period starting the date that other dose of approved vaccine is administered on the individual.
(5A)  Despite paragraph (4), where an individual is assessed as having a COVID‑19 infection, after the individual underwent vaccination and was granted a certificate under that paragraph stating that he or she has a cleared status (general) for a period of 120 days, the Director or a recognised medical practitioner may, where satisfied that the individual is a recovered individual after that infection or any later infection, grant a certificate stating that the individual has a cleared status (general) for a period of 270 days starting on the relevant start date for the last infection.
(5B)  Where paragraph (5A) applies, the Director or a recognised medical practitioner may, where satisfied that the recovered individual has been administered another dose of any approved vaccine (whether before, on or after 1 June 2022) at least 86 days after the relevant start date for that infection, grant a certificate stating the individual has a cleared status (general) for an indefinite period starting the date the other dose is administered.”;
(c)in paragraph (7), replace “or (5)” with “, (5), (5A) or (5B)”; and
(d)delete paragraph (8).
Amendment of regulation 8A
4.  In the principal Regulations, in regulation 8A —
(a)delete paragraph (1);
(b)in paragraph (2), replace “(5)” (wherever it appears) with “(5A)”; and
(c)in paragraph (3), replace “or (5)” with “, (5) or (5B)”.
