Road Traffic Act
(Chapter 276)
Road Traffic (Motor Vehicles, Quota System) (Amendment) Rules 1999
In exercise of the powers conferred by section 10A of the Road Traffic Act, the Minister for Communications hereby makes the following Rules:
Citation and commencement
1.  These Rules may be cited as the Road Traffic (Motor Vehicles, Quota System) (Amendment) Rules 1999 and shall come into operation on 1st April 1999.
Deletion and substitution of rule 3
2.  Rule 3 of the Road Traffic (Motor Vehicles, Quota System) Rules (R 31) (referred to in these Rules as the principal Rules) is deleted and the following rule substituted therefor:
Categories of vehicles
3.—(1)  Each certificate of entitlement shall be issued for not more than one motor vehicle which may fall within any of the following categories:
(a)category A for cars having a cylinder capacity not exceeding 1,600 cubic centimetres and taxis;
(b)category B for cars having a cylinder capacity exceeding 1,600 cubic centimetres;
(c)the category comprising goods vehicles, cement mixers and buses;
(d)the motor cycles category comprising all motor cycles;
(e)the open category comprising any motor vehicles referred to in paragraphs (a) to (d); and
(f)the off-peak cars category comprising motor vehicles which shall be registered as off-peak cars under the Road Traffic (Motor Vehicles, Registration and Licensing) Rules (R 5), except that no certificate of entitlement shall be issued under this sub-paragraph after 30th September 1994.
(2)  For the purposes of paragraph (1)(e), "motor vehicles" shall include any motor car which, on or after 1st October 1994, is intended to be registered as an off-peak car under the Road Traffic (Motor Vehicles, Registration and Licensing) Rules.”.
Amendment of rule 4
3.  Rule 4 of the principal Rules is amended by deleting the words "rule 3 (a) to (f)" in paragraph (2) and substituting the words "rule 3 (a) to (d)".
Amendment of rule 15
4.  Rule 15 of the principal Rules is amended by deleting paragraph (2) and substituting the following paragraphs:
(2)  Any deposit paid by a successful applicant under rule 7 (2) shall be available to be set off against the quota premium or any tax or fee payable by him or any person to whom he has transferred the certificate of entitlement under rule 19.
(3)  If there is any excess after such set off, the excess may be refunded to the applicant upon an application made by him to the Registrar in such form as the Registrar may require.”.
Amendment of rule 17
5.  Rule 17 of the principal Rules is amended —
(a)by deleting the words "rule 3 (1)(h)" wherever they appear in paragraph (1)(c) and substituting in each case the words "rule 3 (1)(f)";
(b)by deleting the words "rule 3 (1)(h)" in the 2nd line of paragraph (2) and substituting the words "rule 3 (1)(f)"; and
(c)by deleting the words "rule 3 (1)(h)" in the marginal note and substituting the words "rule 3 (1)(f)".
Amendment of rule 19
6.  Rule 19 of the principal Rules is amended by deleting the words "rule 3 (a), (b), (c), (d), (f) or (h)" in the 4th line of paragraph (4) and substituting the words "rule 3(a), (b), (d) or (f)".
Amendment of rule 20
7.  Rule 20 of the principal Rules is amended —
(a)by deleting the words "rule 3 (1)(g)" in paragraph (5)(a) and substituting the words "rule 3 (1)(e)";
(b)by deleting the words "rule 3 (1)(a) to (f)" in paragraph (5)(b) and substituting the words "rule 3 (1)(a) to (d)";
(c)by deleting the words "rule 3 (1)(g)" wherever they appear in paragraph (5)(c) and substituting in each case the words "rule 3 (1)(e)";
(d)by deleting the words "rule 3 (a), (b), (c), (d), (e) or (f)" in paragraph (7)(a) and substituting the words "rule 3 (a), (b), (c) or (d)"; and
(e)by deleting the words "rule 3 (1)(g)" wherever they appear in paragraph (7)(b) and substituting in each case the words "rule 3 (1)(e)".
Amendment of rule 22
8.  Rule 22 of the principal Rules is amended —
(a)by deleting the words "rule 3 (1)(h)" in the 3rd line of paragraph (1) and substituting the words "rule 3 (1)(f)";
(b)by deleting the words "rule 3 (1)(a), (b), (c), (d) or (g)" in the 4th and 5th lines of paragraph (1)(a) and substituting the words "rule 3 (1)(a), (b) or (e)";
(c)by deleting the words "rule 3 (1)(h)" wherever they appear in paragraph (1)(b) and substituting in each case the words "rule 3 (1)(f)";
(d)by deleting the words "rule 3 (1)(h)" in paragraph (2) and substituting the words "rule 3 (1)(f)";
(e)by deleting the words "rule 3 (1)(h)" in paragraph (5) and substituting the words "rule 3 (1)(f)"; and
(f)by deleting the words "rule 3 (1)(h)" in the marginal note and substituting the words "rule 3 (1)(f)".
Amendment of First Schedule
9.  The First Schedule to the principal Rules is amended —
(a)by deleting the words "rule 3 (b)" in the 3rd line of paragraph (b) and substituting the words "rule 3 (1)(a)"; and
(b)by deleting the words "category (a), (b), (c) or (d) motor vehicle" wherever they appear in paragraph (d) and substituting in each case the words "category of vehicle specified in rule 3 (1)(a) or (b)".
