Road Traffic Act
(Chapter 276)
Road Traffic (Motor Vehicles, Quota System) (Amendment) Rules 1998
In the exercise of the powers conferred by section 10A(4) of the Road Traffic Act, the Minister for Communications hereby makes the following Rules:
Citation and commencement
1.  These Rules may be cited as the Road Traffic (Motor Vehicles, Quota System) (Amendment) Rules 1998 and shall come into operation on 1st April 1998.
Amendment of rule 2
2.  Rule 2 of the Road Traffic (Motor Vehicles, Quota System) Rules (R 31) (referred to in these Rules as the principal Rules) is amended —
(a)by inserting, immediately after the word “reward” in sub-paragraph (iii) of the definition of “business service passenger vehicle”, the words “unless prior approval of the Registrar has been obtained”; and
(b)by deleting the definitions of “heavy goods vehicle” and “light goods vehicle” and substituting the following definitions:
“ “heavy goods vehicle” means —
(a)a goods vehicle, construction equipment, engineering plant, trivan, motor cycle with a side-car attached to it, recovery vehicle, vehicle used as a mobile canteen or mobile bank, goods-cum-passengers vehicle, or a vehicle used for a specific purpose such as a horse float, the maximum laden weight of which exceeds 3.0 metric tons and which is registered using a certificate of entitlement issued before 1st April 1998;
(b)a goods vehicle, construction equipment, engineering plant, trivan, recovery vehicle, vehicle used as a mobile canteen or mobile bank, goods-cum-passengers vehicle, or a vehicle used for a specific purpose such as a horse float, the maximum laden weight of which exceeds 3.5 metric tons and which is registered using a certificate of entitlement issued on or after 1st April 1998;
“light goods vehicle” means —
(a)a goods vehicle, construction equipment, engineering plant, trivan, motor cycle with a side-car attached to it, recovery vehicle, vehicle used as a mobile canteen or mobile bank, goods-cum-passengers vehicle, or a vehicle used for a specific purpose such as a horse float, the maximum laden weight of which does not exceed 3.0 metric tons and which is registered using a certificate of entitlement issued prior to 1st April 1998;
(b)a goods vehicle, any construction equipment, engineering plant, trivan, motor cycle with a side-car attached to it, recovery vehicle, vehicle used as a mobile canteen or mobile bank, a goods-cum-passengers vehicle, or a vehicle used for a specific purpose such as a horse float, the maximum laden weight of which does not exceed 3.5 metric tons and which is registered using a certificate of entitlement issued on or after 1st April 1998;”.
Amendment of rule 14
3.  Rule 14 of the principal Rules is amended —
(a)by deleting the words “paragraph (a)” in paragraph (1)(b) and substituting the words “sub-paragraph (a)”;
(b)by deleting the words “paragraph (a)” in paragraph (1)(c) and substituting the words “sub-paragraph (a)”;
(c)by deleting sub-paragraph (d) of paragraph (1) and substituting the following sub-paragraph:
(d)70% of the amount calculated in accordance with sub-paragraph (a) if the motor vehicle is —
(i)a taxi; or
(ii)a private hire car, registered using a certificate of entitlement issued before 1st April 1998.”; and
(d)by inserting, immediately after paragraph (3), the following paragraph:
(4)  Paragraph (1)(b) of this rule shall not apply to a business service passenger vehicle registered using a certificate of entitlement issued on or after 1st April 1998.”.
Amendment of rule 16
4.  Rule 16(1) of the principal Rules is amended by inserting, immediately after the words “a private hire car”, the words “registered using a certificate of entitlement issued before 1st April 1998”.
Amendment of First Schedule
5.  The First Schedule to the principal Rules is amended by inserting, immediately after the word “vehicle” in the first line of paragraph (c), the words “registered using a certificate of entitlement issued before 1st April 1998”.
