Smoking
(Prohibition in Certain Places)
(Amendment) Notification 2013
In exercise of the powers conferred by section 3(1) of the Smoking (Prohibition in Certain Places) Act, the National Environment Agency, with the approval of the Minister for the Environment and Water Resources, hereby makes the following Notification:
Citation and commencement
1.  This Notification may be cited as the Smoking (Prohibition in Certain Places) (Amendment) Notification 2013 and shall come into operation on 15th January 2013.
Amendment of paragraph 2
2.  Paragraph 2 of the Smoking (Prohibition in Certain Places) Notification (N 1) is amended —
(a)by inserting, immediately after the word “infirmity” in the definition of “hospital”, the words “, including the grounds of the hospital, any car park within those grounds and any area within the compound of the hospital”; and
(b)by inserting, immediately after the definition of “office premises”, the following definition:
“ “pavilion” means any covered area that is used or intended to be used principally for holding funerals, weddings, gatherings, meetings or other communal or social functions;”.
Amendment of First Schedule
3.  The First Schedule to the Smoking (Prohibition in Certain Places) Notification is amended —
(a)by deleting item 15 and substituting the following items:
15.  Any common area of any residential premises or building, including any atrium, courtyard, common corridor, lobby, void deck or stairwell.
15A.  Any pavilion within the common property or limited common property of any residential premises or building.”;
(b)by deleting item 19 and substituting the following items:
19.  Any covered or underground pedestrian walkway, whether permanent or temporary.
19A.  Any covered drop-off or pick-up point for passengers in vehicles, whether permanent or temporary and whether connected to a covered pedestrian walkway or otherwise.
19B.  Any pedestrian overhead bridge.”;
(c)by deleting the words “, bus terminus” in item 29 and substituting the words “or bus terminus”;
(d)by deleting the words “or bus shelter” in item 29; and
(e)by inserting, immediately after item 29, the following item:
29A.  Any bus stop or bus shelter, including any area within a radius of 5 metres from the outer edge of the shelter or, where there is no such shelter, from the bus stop pole.”.
