(Motor Vehicles, Quota System)
(Amendment) Rules 2021
In exercise of the powers conferred by section 10A(4) of the Road Traffic Act, the Minister for Transport makes the following Rules:
Citation and commencement
1.  These Rules are the Road Traffic (Motor Vehicles, Quota System) (Amendment) Rules 2021 and come into operation on 1 April 2021.
Amendment of rule 2
2.  Rule 2(1) of the Road Traffic (Motor Vehicles, Quota System) Rules (R 31) is amended by inserting, immediately after the definition of “Euro III standard”, the following definition:
“ “Euro IV standard” means —
(a)in relation to a diesel driven motor car, a standard for exhaust emission that complies with the standard specified in row B of the table referred to in paragraph 13 of the Annex to Directive 98/69/EC of the European Parliament and of the Council of the European Union;
(b)in relation to a diesel driven motor vehicle (other than a motor car) with gross vehicle weight not exceeding 3.5 tons, a standard for exhaust emission that complies with the standard specified in row B of the table referred to in paragraph 13 of the Annex to Directive 98/69/EC of the European Parliament and of the Council of the European Union; or
(c)in relation to a diesel driven motor vehicle (other than a motor car) with gross vehicle weight exceeding 3.5 tons, a standard for exhaust emission that complies with the standard specified in row B1 of Table 1 or row B1 of Table 2 contained in the Annex to Directive 1999/96/EC of the European Parliament and of the Council of the European Union;”.
Amendment of rule 9C
3.  Rule 9C of the Road Traffic (Motor Vehicles, Quota System) Rules is amended —
(a)by deleting the word “or” at the end of paragraph (2)(c)(i);
(b)by inserting, immediately after sub‑paragraph (i) of paragraph (2)(c), the following sub‑paragraph:
(ia)is registered during the period from 1 January 2001 to 31 December 2013 (both dates inclusive) and deregistered during the period from 1 April 2021 to 31 March 2023 (both dates inclusive); or”;
(c)by deleting the words “or the Euro III standard” in paragraph (2)(c)(ii) and substituting the words “, Euro III standard or Euro IV standard”;
(d)by deleting the words “31 March 2021” in paragraph (2)(c)(ii) and substituting the words “31 March 2023”;
(e)by inserting, immediately after sub‑paragraph (b) of paragraph (3), the following sub‑paragraph:
(ba)the replacement vehicle is not a light commercial vehicle mentioned in rule 3(3) of the Road Traffic (Vehicular Emissions Tax) Rules 2017 (G.N. No. S 776/2017);”;
(f)by deleting the definition of “D” in paragraph (4)(b) and substituting the following definition:
 
“D
is the number determined in accordance with paragraph (5); and”; and
(g)by inserting, immediately after paragraph (4), the following paragraph:
(5)  For the purposes of paragraph (4)(b), D is —
(a)for a replaced vehicle that has a maximum laden weight not exceeding 3,500 kilograms —
(i)in a case where the replaced vehicle complies with the Euro II standard or Euro III standard (but not any higher standard) or is first registered under the Act during the period from 1 January 2001 to 30 September 2006 (both dates inclusive) — 45%; and
(ii)in any other case — 20%; or
(b)for a replaced vehicle that has a maximum laden weight exceeding 3,500 kilograms —
(i)in a case where the replaced vehicle complies with the Euro II standard or Euro III standard (but not any higher standard) or is first registered under the Act during the period from 1 January 2001 to 30 September 2006 (both dates inclusive) —
(A)if the replacement vehicle has a maximum laden weight exceeding 3,500 kilograms and does not produce, as exhaust, any gaseous emissions of carbon monoxide, nitrogen oxides, hydrocarbons or particulate pollutants — 100%; and
(B)if the replacement vehicle is not a vehicle mentioned in sub‑paragraph (A) — 80%; and
(ii)in any other case —
(A)if the replacement vehicle has a maximum laden weight exceeding 3,500 kilograms and does not produce, as exhaust, any gaseous emissions of carbon monoxide, nitrogen oxides, hydrocarbons or particulate pollutants — 80%; and
(B)if the replacement vehicle is not a vehicle mentioned in sub‑paragraph (A) — 40%.”.
