Mass Rapid Transit (Railway Protection, Restricted Activities) (Amendment No. 2) Regulations 1996

In exercise of the powers conferred by section 42 of the Rapid Transit Systems Act, the Land Transport Authority of Singapore, with the approval of the Minister for Communications, hereby makes the following Regulations:

1. These Regulations may be cited as the Mass Rapid Transit (Railway Protection, Restricted Activities) (Amendment No. 2) Regulations 1996 and shall come into operation on 15th May 1996.

2. Regulation 2 of the Mass Rapid Transit (Railway Protection, Restricted Activities) Regulations (referred to in these Regulations as the principal Regulations) is amended by inserting, immediately after the definition of “owner”, the following definition:

““railway protection zone” means that part of the land or area which is within 40 metres from the outermost edge of any part of the railway that is on, above or below the ground;”.

3. Regulation 3 of the principal Regulations is amended by inserting, immediately after the word “zone” at the end thereof, the words “and the railway protection zone”.

4. Regulation 4(1) of the principal Regulations is amended by inserting, immediately after the word “zone” at the end thereof, the words “and the railway protection zone”.

5. Regulation 5 of the principal Regulations is amended by deleting paragraph (1) and substituting the following paragraph:

“(1) No person shall carry out any restricted activity within 6 metres of the outermost edge of any part of the railway (whether on or above the ground) that is alongside or within the railway safety zone or the railway protection zone.”.

6. Regulation 6(1) of the principal Regulations is amended by inserting, immediately after the word “zone” in the third line, the words “or the railway protection zone”.

7. The principal Regulations are amended by inserting, immediately after regulation 6, the following regulation:

“Railway protection zone

6A.—(1) No person shall carry out any restricted activity within the railway protection zone unless the Authority has given him its permission in writing to do so.

(2) The Authority may, in giving such permission, impose such terms and conditions as it thinks fits.

(3) Any person who carries out any restricted activity in contravention of paragraph (1) or fails to comply with any term and condition imposed by the Authority under paragraph (2) shall be guilty of an offence.”.

8. Regulation 7(1) of the principal Regulations is amended by inserting, immediately after the word “zone” in the second line, the words “or the railway protection zone”.

9. Regulation 8(1) of the principal Regulations is amended by inserting, immediately after the word “zone” in the third line, the words “or the railway protection zone”.

10. The Schedule to the principal Regulations is amended —

(a)	by deleting the words “where any part of such equipment or vehicle at any stage of its operation or movement is within 10 metres of the outermost edge of any structure of the Mass Rapid Transit System which is on or above the ground” in regulation 1(a);
(b)	by deleting the words “within the railway safety zone” in regulation 1(b); and
(c)	by deleting the words “, within 10 metres of the outermost edge of any structure of the Mass Rapid Transit System which is on or above the ground” in regulation 1(c).
