(Indian and Other Minority
Communities Committee)
(Amendment) Regulations 2019
In exercise of the powers conferred by sections 27C(9) and 102 of the Parliamentary Elections Act, the Prime Minister makes the following Regulations:
Citation and commencement
1.  These Regulations are the Parliamentary Elections (Indian and Other Minority Communities Committee) (Amendment) Regulations 2019 and come into operation on 1 April 2019.
New regulation 1A
2.  The Parliamentary Elections (Indian and Other Minority Communities Committee) Regulations (Rg 2) (called in these Regulations the principal Regulations) are amended by inserting, immediately after regulation 1, the following regulation:
Definitions
1A.  In these Regulations, unless the context otherwise requires —
“applicant” means a person who applies under section 27A(5) of the Act for a certificate that the person belongs to the Indian or other minority communities;
“Secretary” means the Secretary to the Committee appointed under regulation 7.”.
Amendment of regulation 2
3.  The principal Regulations are amended by renumbering regulation 2 as paragraph (1) of that regulation, and by inserting immediately thereafter the following paragraph:
(2)  Unless any member of the Committee objects, the Committee may despatch business without meeting in person if the Chairman of the Committee so directs.”.
Deletion and substitution of regulation 7
4.  Regulation 7 of the principal Regulations is deleted and the following regulation substituted therefor:
Secretary
7.—(1)  The Chairman of the Committee may appoint a public officer to be the Secretary to the Committee.
(2)  The Secretary may convey any decision, direction, request or information on behalf of the Committee, and may also perform such other duties as the Chairman of the Committee may assign.
(3)  The office of the Secretary is to be at the Elections Department.”.
New regulation 10A
5.  The principal Regulations are amended by inserting, immediately after regulation 10, the following regulation:
Fact-finding, etc.
10A.—(1)  The Committee may, for the purposes of determining whether an applicant belongs to the Indian or other minority communities —
(a)require the applicant to provide further information;
(b)interview the applicant;
(c)inform itself on any matter; and
(d)consult any person.
(2)  In determining whether an applicant belongs to the Indian or other minority communities, the Committee may take into account any refusal by the applicant to provide further information or to be interviewed.”.
Amendment of regulation 13
6.  Regulation 13 of the principal Regulations is amended —
(a)by deleting the words “from the Returning Officer” and substituting the words “issued to the applicant”; and
(b)by deleting the words “from Returning Officer” in the regulation heading.
Deletion of regulations 14 and 15
7.  Regulations 14 and 15 of the principal Regulations are deleted.
Amendment of regulation 16
8.  Regulation 16 of the principal Regulations is amended by deleting the words “Returning Officer” (including in the regulation heading) and substituting in each case the word “Secretary”.
Amendment of regulation 17
9.  Regulation 17 of the principal Regulations is amended by deleting the words “channelled through the Elections Department” and substituting the words “sent to the Secretary”.
Deletion and substitution of Schedule
10.  The Schedule to the principal Regulations is deleted and the following Schedule substituted therefor:

     In accordance with section 27A(5) of the Parliamentary Elections Act, I am applying to the Indian and Other Minority Communities Committee for a certificate certifying that I am a person belonging to the Indian or other minority communities.
