Constitution of the Republic of Singapore
Legal Service (Personnel Boards) (Amendment)
Order 2014
In exercise of the powers conferred by Article 111AA(1), (2) and (8) of the Constitution of the Republic of Singapore, the President, on the advice of the Prime Minister, hereby makes the following Order:
Citation and commencement
1.  This Order may be cited as the Legal Service (Personnel Boards) (Amendment) Order 2014 and shall come into operation on 1st April 2014.
Amendment of paragraph 2
2.  Paragraph 2 of the Legal Service (Personnel Boards) Order 2007 (G.N. No. S 654/2007) (referred to in this Order as the principal Order) is amended by deleting the words “the Special Personnel Board or the Senior Personnel Board” in the definition of “Personnel Board” and substituting the words “the Judicial Branch Special Personnel Board or the Legal Branch Special Personnel Board”.
Deletion and substitution of paragraphs 4 and 5
3.  Paragraphs 4 and 5 of the principal Order are deleted and the following paragraphs substituted therefor:
Judicial Branch Special Personnel Board
4.—(1)  There is hereby established a Judicial Branch Special Personnel Board in respect of all officers in the Singapore Legal Service below the threshold grade who hold or is to hold a post in the Supreme Court or the State Courts.
(2)  The Judicial Branch Special Personnel Board shall have the jurisdiction and power to do all of the following:
(a)to first appoint as an officer in the Singapore Legal Service at a grade below the threshold grade and to hold a post in the Supreme Court or the State Courts;
(b)to confirm or emplace on the permanent establishment any officer below the threshold grade who holds a post in the Supreme Court or the State Courts;
(c)to promote any officer who holds a post in the Supreme Court or the State Courts to any grade below the threshold grade.
(3)  In addition, the Judicial Branch Special Personnel Board shall have the jurisdiction and power —
(a)to transfer from the Singapore Legal Service to another Scheme of Service in the public service, any officer below the threshold grade who holds a post in the Supreme Court or the State Courts; or
(b)to transfer any public officer from another Scheme of Service in the public service to be an officer in the Singapore Legal Service below the threshold grade and to hold a post in the Supreme Court or the State Courts,
with the prior agreement of the Public Service Commission or the relevant Personnel Board established under Article 110D of the Constitution having jurisdiction and power over the other Scheme of Service or the public officer to be transferred, as the case may be.
Legal Branch Special Personnel Board
5.—(1)  There is hereby established a Legal Branch Special Personnel Board in respect of all officers in the Singapore Legal Service below the threshold grade who hold or is to hold a post in the public service outside of the Supreme Court or the State Courts.
(2)  The Legal Branch Special Personnel Board shall have the jurisdiction and power to do all of the following:
(a)to first appoint as an officer in the Singapore Legal Service at a grade below the threshold grade and to hold a post outside of the Supreme Court and the State Courts;
(b)to confirm or emplace on the permanent establishment any officer below the threshold grade who holds a post outside of the Supreme Court and the State Courts;
(c)to promote any officer who holds a post outside of the Supreme Court and the State Courts to any grade below the threshold grade.
(3)  In addition, the Legal Branch Special Personnel Board shall have the jurisdiction and power —
(a)to transfer from the Singapore Legal Service to another Scheme of Service in the public service, any officer below the threshold grade who holds a post outside of the Supreme Court and the State Courts; or
(b)to transfer any public officer from another Scheme of Service in the public service to be an officer in the Singapore Legal Service below the threshold grade and to hold a post outside of the Supreme Court and the State Courts,
with the prior agreement of the Public Service Commission or the relevant Personnel Board established under Article 110D of the Constitution having jurisdiction and power over the other Scheme of Service or the public officer to be transferred, as the case may be.”.
Deletion and substitution of Schedule
4.  The Schedule to the principal Order is deleted and the following Schedule substituted therefor:
