(Amendment) Regulations 2020

In exercise of the powers conferred by section 67 of the Active Mobility Act 2017, the Land Transport Authority of Singapore, with the approval of the Minister for Transport, makes the following Regulations:

Citation and commencement

1. These Regulations are the Active Mobility (Registration of Registrable Personal Mobility Devices) (Amendment) Regulations 2020 and come into operation on 3 April 2020.

Amendment of regulation 2

2. Regulation 2 of the Active Mobility (Registration of Registrable Personal Mobility Devices) Regulations 2019 (G.N. No. S 13/2019) (called in these Regulations the principal Regulations) is amended by deleting the definitions of “CorpPass” and “SingPass”.

Amendment of regulation 5

3. Regulation 5(1) of the principal Regulations is amended by inserting, immediately after sub‑paragraph (da), the following sub‑paragraph:

“(db)

a certification of inspection that is issued under section 35C(1) of the Act relating to the registrable personal mobility device and that is in force;”.

Amendment of regulation 7

4. Regulation 7 of the principal Regulations is amended by inserting, immediately after paragraph (a), the following paragraph:

“(aa)

there is no certification of inspection issued under section 35C(1) of the Act relating to the registrable personal mobility device, or the last such certification issued in relation to that registrable personal mobility device is not in force;”.

Amendment of regulation 13

5. Regulation 13(1) of the principal Regulations is amended by inserting, immediately after sub‑paragraph (d), the following sub‑paragraph:

“(da)

an order under section 47(1)(b) of the Act has been given with respect to the registrable personal mobility device and the order has not been complied with;”.

Amendment of regulation 16

6. Regulation 16 of the principal Regulations is amended by deleting paragraphs (a), (b) and (c) and substituting the following paragraphs:

“(a)

at the business premises of a designated examiner authorised under section 35B of the Act as follows, between the hours of 8 a.m. and 5 p.m. (except Sundays and public holidays):

(i)

JIC Inspection Services Pte Ltd at —

(A)	53 Pioneer Road, Singapore 628505; or
(B)	21 Ang Mo Kio Street 63, Singapore 569118;

(ii)

STA Inspection Pte Ltd at —

(A)	249 Jalan Boon Lay, Singapore 619523; or
(B)	302 Sin Ming Road, Singapore 575627;

(iii)

VICOM Ltd. at —

(A)	385 Sin Ming Drive, Singapore 575718;
(B)	501 Yishun Industrial Park A, Singapore 768732;
(C)	20 Changi North Crescent, Singapore 499613;
(D)	23 Kaki Bukit Avenue 4, Singapore 415933; or
(E)	511 Bukit Batok Street 23, Singapore 659545;

(b)

in exceptional circumstances, at the office of the Authority at 10 Sin Ming Drive, Singapore 575701 during its business hours.”.

Deletion of regulation 17

7. Regulation 17 of the principal Regulations is deleted.

Amendment of regulation 23

8. Regulation 23(2) of the principal Regulations is amended by deleting sub‑paragraphs (a), (b) and (c) and substituting the following sub‑paragraphs:

“(a)	$7.49 for each successful online search for an entry in the registrable PMD register (whether or not an electronic copy or extract of the found entry is made);
(b)	$19.26 for each non‑online search for an entry in the registrable PMD register (including a printed copy or extract of the found entry);
(c)	$5.35 for certifying by an authorised officer a copy or an extract of an entry in the registrable PMD register found by a non‑online search.”.

Amendment of regulation 29

9. Regulation 29 of the principal Regulations is amended —

(a)

by inserting, immediately before the words “registered registrable PMD”, the words “March 2020”; and

(b)

by renumbering the regulation as paragraph (1) of that regulation, and by inserting immediately thereafter the following paragraphs:

“(2) For the purposes of section 28G(1)(b) of the Act, the registered responsible person for an April 2020 registered registrable PMD must ensure that any identification mark for that PMD is affixed and displayed on the PMD —

(a)

as follows, whichever is practicable:

(i)	permanently affixed on any part of the front or back portion of the PMD;
(ii)	permanently affixed to an accessory that is permanently attached to the front or back of the PMD;
(iii)	permanently affixed at such other part of the PMD as the Authority may allow in any particular case; and

(b)

so that the identification mark —

(i)	is not obscured;
(ii)	is visible from the front or back of the PMD whether the PMD is stationary or in motion;
(iii)	is not upside down; and
(iv)	is displayed in compliance with the Schedule.

(3) In this regulation —

“March 2020 registered registrable PMD” means a registered registrable PMD —

(a)	the registration of which was granted before 3 April 2020; and
(b)	that, on 3 April 2020, has affixed and displayed on it, in compliance with paragraph (1), the identification mark for the PMD; and

“April 2020 registered registrable PMD” means a registered registrable PMD —

(a)	the registration of which is granted on or after 3 April 2020; or
(b)	the registration of which was granted before 3 April 2020 and that on that date, does not have affixed and displayed on it, in compliance with paragraph (1), the identification mark for the PMD.”.
