(Workfare Income Supplement Scheme)
(Amendment) Regulations 2012
In exercise of the powers conferred by section 57F of the Central Provident Fund Act, the Minister for Manpower hereby makes the following Regulations:
Citation and commencement
1.—(1)  These Regulations may be cited as the Central Provident Fund (Workfare Income Supplement Scheme) (Amendment) Regulations 2012 and shall with the exception of regulation 7(d), come into operation on 31st May 2012.
(2)  Regulation 7(d) shall be deemed to have come into operation on 1st July 2010.
Amendment of regulation 2
2.  Regulation 2(1) of the Central Provident Fund (Workfare Income Supplement Scheme) Regulations (Rg 36) (referred to in these Regulations as the principal Regulations) is amended —
(a)by inserting, immediately after the definition of “income”, the following definitions:
“ “quarter” means a period of 3 consecutive months in a year;
“relevant quarter” means a quarter in a relevant year ending on the last day of March, June, September or December, in respect of which a member’s eligibility to receive any benefit under the Scheme is assessed;”; and
(b)by deleting the full-stop at the end of the definition of “self‑employed person” and substituting a semi-colon, and by inserting immediately thereafter the following definition:
“ “specified member” means a person who is attending, or has attended, any school —
(a)which is or was specified in Part II of the Schedule to the Education Endowment and Savings Schemes (Edusave Pupils Fund) Regulations (Cap. 87A; Rg 1); or
(b)which was listed under the category “Special Education Schools” in the Schedule to the revoked Education Endowment Scheme (Prescribed Schools) Regulations (Cap. 87A; Rg 1).”.
Amendment of regulation 3
3.  Regulation 3(1) of the principal Regulations is amended —
(a)by deleting sub-paragraph (a) and substituting the following sub-paragraph:
(a)he is a Singapore citizen, or becomes a Singapore citizen —
(i)if the relevant year is 2007, 2008, 2009, 2010 or 2011, on or before 1st January in the year immediately following the relevant year; or
(ii)if the relevant year is 2012 or any subsequent year, on or before —
(A)the last day in a relevant quarter, for the purposes only of assessing his eligibility to receive any benefit for that relevant quarter;
(B)the last day in a quarter referred to in regulation 5(6D), for the purposes only of assessing his eligibility to receive any benefit for that quarter; or
(C)31st December in the relevant year, for any other purpose;”;
(b)by inserting, immediately after the words “the relevant year” in sub-paragraph (b), the words “or is a specified member”; and
(c)by deleting sub-paragraphs (d) and (e) and substituting the following sub-paragraphs:
(d)he has worked as an employee —
(i)if the relevant year is 2007, 2008, 2009, 2010 or 2011, for a period of at least —
(A)3 months in any 6 consecutive months in the relevant year; or
(B)6 months in the relevant year; or
(ii)if the relevant year is 2012 or any subsequent year, for a period of at least —
(A)2 months in any quarter in the relevant year;
(B)3 months in any 6 consecutive months in the relevant year; or
(C)6 months in the relevant year; and
(e)either of the following applies to him:
(i)if the relevant year is 2007, 2008, 2009, 2010 or 2011, during the period or periods in the relevant year, or (for the purposes only of assessing his eligibility to receive any provisional payment or credit) in the first 6 months of the relevant year, he earned an average monthly wage of —
(A)more than $50 but less than $1,500, in any case where the relevant year is 2007, 2008 or 2009; or
(B)more than $50 but not more than $1,700, in any case where the relevant year is 2010 or 2011; or
(ii)if the relevant year is 2012 or any subsequent year, during the period or periods in the relevant year, he earned an average monthly wage of more than $50 but not more than $1,700.”.
Amendment of regulation 4
4.  Regulation 4 of the principal Regulations is amended —
(a)by deleting sub-paragraph (a) of paragraph (1) and substituting the following sub-paragraph:
(a)he is a Singapore citizen, or becomes a Singapore citizen —
(i)if the relevant year is 2007, 2008, 2009, 2010 or 2011, on or before 1st January in the year immediately following the relevant year; or
(ii)if the relevant year is 2012 or any subsequent year, on or before 31st December in the relevant year;”;
(b)by inserting, immediately after the words “the relevant year” in paragraph (1)(b), the words “or is a specified member”;
(c)by deleting sub-paragraph (ii) of paragraph (1)(d) and substituting the following sub-paragraph:
(ii)he commenced working as a self-employed person during the relevant year, and he has worked as a self-employed person —
(A)if the relevant year is 2007, 2008, 2009, 2010 or 2011, for a period of at least —
(AA)3 months in any 6 consecutive months in the relevant year; or
(AB)6 months in the relevant year; or
(B)if the relevant year is 2012 or any subsequent year, for a period of at least —
(BA)2 months in any quarter in the relevant year;
(BB)3 months in any 6 consecutive months in the relevant year; or
(BC)6 months in the relevant year;”;
(d)by inserting, immediately after the words “any provisional credit” in paragraph (1)(ea), the words “for any relevant year from 2007 to 2011”;
(e)by inserting, immediately after the words “any relevant year” in paragraph (1A)(b), the words “from 2007 to 2011”;
(f)by deleting the word “or” at the end of paragraph (1B)(b)(iii);
(g)by deleting sub-paragraph (c) of paragraph (1B) and substituting the following sub-paragraphs:
(c)where he has attained 45 years of age but is below 50 years of age on 1st January that year —
(i)an amount equal to 2.83% of the relevant income, subject to a minimum of $17, if that year is 2007, 2008 or 2009;
(ii)an amount equal to 2.89% of the relevant income, subject to a minimum of $17, if that year is 2010; or
(iii)an amount equal to 3% of the relevant income, subject to a minimum of $18, if that year is 2011 or any subsequent year; or
(d)where he is 50 years of age or older on 1st January that year —
(i)an amount equal to 2.83% of the relevant income, subject to a minimum of $17, if that year is 2007, 2008 or 2009;
(ii)an amount equal to 2.89% of the relevant income, subject to a minimum of $17, if that year is 2010;
(iii)an amount equal to 3% of the relevant income, subject to a minimum of $18, if that year is 2011 or 2012; or
(iv)an amount equal to 3.17% of the relevant income, subject to a minimum of $19, if that year is 2013 or any subsequent year.”;
(h)by deleting the words “any relevant year (being 2011 or any subsequent year)” in paragraph (2B) and substituting the words “the relevant year 2011”; and
(i)by inserting, immediately after the words “any provisional credit” wherever they appear in paragraph (3), the words “for any relevant year from 2007 to 2011”.
Amendment of regulation 4A
5.  Regulation 4A of the principal Regulations is amended —
(a)by deleting sub-paragraph (a) of paragraph (1) and substituting the following sub-paragraph:
(a)he is a Singapore citizen, or becomes a Singapore citizen —
(i)if the relevant year is 2007, 2008, 2009, 2010 or 2011, on or before 1st January in the year immediately following the relevant year; or
(ii)if the relevant year is 2012 or any subsequent year, on or before —
(A)the last day in a relevant quarter, for the purposes only of assessing his eligibility to receive any benefit for that relevant quarter;
(B)the last day in a quarter referred to in regulation 6A(7D), for the purposes only of assessing his eligibility to receive any benefit for that quarter; or
(C)31st December in the relevant year, for any other purpose;”;
(b)by inserting, immediately after the words “the relevant year” in paragraph (1)(b), the words “or is a specified member”;
(c)by deleting sub-paragraphs (d) and (e) of paragraph (1) and substituting the following sub-paragraphs:
(d)either of the following applies to him:
(i)he has worked —
(A)as an employee —
(AA)if the relevant year is 2007, 2008, 2009, 2010 or 2011, for a period of at least —
(I)3 months in any 6 consecutive months in the relevant year; or
(II)6 months in the relevant year; or
(AB)if the relevant year is 2012 or any subsequent year, for a period of at least —
(I)2 months in any quarter in the relevant year;
(II)3 months in any 6 consecutive months in the relevant year; or
(III)6 months in the relevant year; and
(B)as a self-employed person for a period of at least one month in the relevant year; or
(ii)he has worked —
(A)as a self-employed person —
(AA)if the relevant year is 2007, 2008, 2009, 2010 or 2011, for a period of at least —
(I)3 months in any 6 consecutive months in the relevant year; or
(II)6 months in the relevant year; or
(AB)if the relevant year is 2012 or any subsequent year, for a period of at least —
(I)2 months in any quarter in the relevant year;
(II)3 months in any 6 consecutive months in the relevant year; or
(III)6 months in the relevant year; and
(B)as an employee for a period of at least one month in the relevant year;
(e)either of the following applies to him:
(i)if the relevant year is 2007, 2008, 2009, 2010 or 2011, during the period or periods in the relevant year, or (for the purposes only of assessing his eligibility to receive any provisional payment or credit) in the first 6 months of the relevant year, he earned an average monthly income of —
(A)more than $50 but less than $1,500, in any case where the relevant year is 2007, 2008 or 2009;
(B)more than $50 but not more than $1,700, in any case where the relevant year is 2010; or
(C)not more than $1,700, in any case where the relevant year is 2011; or
(ii)if the relevant year is 2012 or any subsequent year, during the period or periods in the relevant year —
(A)for the purposes only of assessing his eligibility to receive any benefit for any quarter, he earned as an employee an average monthly wage of more than $50 but not more than $1,700; or
(B)for any other purpose, he earned an average monthly income of not more than $1,700;”;
(d)by inserting, immediately after the words “any relevant year” in paragraph (2)(b), the words “from 2007 to 2011”;
(e)by deleting the word “or” at the end of paragraph (3)(b)(iii);
(f)by deleting sub-paragraph (c) of paragraph (3) and substituting the following sub-paragraphs:
(c)where he has attained 45 years of age but is below 50 years of age on 1st January that year —
(i)an amount equal to 2.83% of the relevant income, subject to a minimum of $17, if that year is 2007, 2008 or 2009;
(ii)an amount equal to 2.89% of the relevant income, subject to a minimum of $17, if that year is 2010; or
(iii)an amount equal to 3% of the relevant income, subject to a minimum of $18, if that year is 2011 or any subsequent year; or

(g)by deleting the words “any relevant year (being 2011 or any subsequent year)” in paragraph (6) and substituting the words “the relevant year 2011”; and
(h)by inserting, immediately after the words “any provisional payment or credit” wherever they appear in paragraph (8), the words “for any relevant year from 2007 to 2011”.
Amendment of regulation 5
6.  Regulation 5 of the principal Regulations is amended —
(a)by deleting paragraph (2) and substituting the following paragraph:
(2)  Subject to paragraphs (6B) and (6E), the total value of all benefits which an employed eligible member is entitled to receive in any relevant year shall be as follows:
(a)where he satisfies the requirement under regulation 3(1)(d)(i)(B) or (ii)(C), the total value of all benefits which he is entitled to receive is as set out in —
(i)the table under paragraph 1 of the First Schedule, if the relevant year is 2007, 2008 or 2009; or
(ii)the table under paragraph 2 of the First Schedule, if the relevant year is 2010 or any subsequent year;
(b)where he satisfies the requirement under regulation 3(1)(d)(i)(A) or (ii)(B) but fails to satisfy the requirement under regulation 3(1)(d)(i)(B) or (ii)(C) (as the case may be), the total value of all benefits which he is entitled to receive is as set out in —
(i)the table under paragraph 1 of the Second Schedule, if the relevant year is 2007, 2008 or 2009; or
(ii)the table under paragraph 2 of the Second Schedule, if the relevant year is 2010 or any subsequent year; or
(c)where he satisfies the requirement under regulation 3(1)(d)(ii)(A) but fails to satisfy the requirements under regulation 3(1)(d)(ii)(B) and (C), the total value of all benefits which he is entitled to receive is as set out in the table under paragraph 3 of the Second Schedule.”;
(b)by deleting the words “paragraph (4)” in paragraph (3) and substituting the words “paragraphs (4) and (6C)”;
(c)by inserting, immediately after the words “in any relevant year” in paragraphs (4) and (5), the words “from 2007 to 2011”;
(d)by deleting the words “any subsequent year” in paragraphs (4)(a)(ii), (5)(b) and (6) and substituting in each case “2011”;
(e)by inserting, immediately after the words “eligible member” in paragraph (5), the words “referred to in paragraph (4)”;
(f)by inserting, immediately after paragraph (6), the following paragraphs:
(6A)  An employed eligible member is entitled to receive the benefits for any relevant quarter in 2012 or any subsequent year, if —
(a)he is a Singapore citizen, or becomes a Singapore citizen, on or before the last day of that relevant quarter; and
(b)he has worked as an employee for a period of at least 2 months in that relevant quarter.
(6B)  The value of the benefits which an employed eligible member is entitled under paragraph (6A) to receive for each relevant quarter is as set out in the table under paragraph 3 of the Second Schedule.
(6C)  An employed eligible member is entitled under paragraph (6A) —
(a)to receive the benefits for the first 3 relevant quarters in any relevant year (being 2012 or any subsequent year) before the end of the relevant year; and
(b)to receive the remainder of the benefits to which he is entitled in the relevant year (including the benefits for the fourth relevant quarter in the relevant year) as soon as practicable in the year immediately following the relevant year.
(6D)  An employed eligible member is entitled to receive the benefits for any quarter (not being a relevant quarter) in 2012 or any subsequent year where he has worked as an employee in the last month of that quarter, if —
(a)he is a Singapore citizen, or becomes a Singapore citizen, on or before the last day of that quarter;
(b)he has worked as an employee for a period of at least 2 months in that quarter; and
(c)no part of that quarter forms any part of a relevant quarter for which the member is entitled under paragraph (6A) to receive any benefits.
(6E)  The value of the benefits which an employed eligible member is entitled under paragraph (6D) to receive for each quarter is as set out in the table under paragraph 3 of the Second Schedule.”; and
(g)by deleting the words “paragraphs (1), (1A), (2), (4) and (5)” in paragraph (7) and substituting the words “paragraphs (1), (1A), (2), (4), (5) and (6A) to (6E)”.
Amendment of regulation 6
7.  Regulation 6 of the principal Regulations is amended —
(a)by deleting paragraph (2) and substituting the following paragraph:
(2)  The total value of all benefits which a self‑employed eligible member is entitled to receive in any relevant year shall be as follows:
(a)where he satisfies the requirement under regulation 4(1)(d)(i) or (ii)(A)(AB) or (B)(BC), the total value of all benefits which he is entitled to receive is as set out in —
(i)the table under paragraph 1 of the Third Schedule, if the relevant year is 2007, 2008 or 2009; or
(ii)the table under paragraph 2 of the Third Schedule, if the relevant year is 2010 or any subsequent year;
(b)where he satisfies the requirement under regulation 4(1)(d)(ii)(A)(AA) or (B)(BB) but fails to satisfy the requirement under regulation 4(1)(d)(ii)(A)(AB) or (B)(BC) (as the case may be), the total value of all benefits which he is entitled to receive is as set out in —
(i)the table under paragraph 1 of the Fourth Schedule, if the relevant year is 2007, 2008 or 2009; or
(ii)the table under paragraph 2 of the Fourth Schedule, if the relevant year is 2010 or any subsequent year; or
(c)where he satisfies the requirement under regulation 4(1)(d)(ii)(B)(BA) but fails to satisfy the requirements under regulation 4(1)(d)(ii)(B)(BB) and (BC), the total value of all benefits which he is entitled to receive is as set out in the table under paragraph 3 of the Fourth Schedule.”;
(b)by inserting, immediately after the words “in any relevant year” in paragraphs (4) and (5), the words “from 2007 to 2011”;
(c)by deleting the words “any subsequent year” in paragraphs (4)(a)(ii) and (c), (5)(b) and (6) and substituting in each case “2011”; and
(d)by deleting the words “an employed eligible member” in paragraph (7) and substituting the words “a self‑employed eligible member”.
Amendment of regulation 6A
8.  Regulation 6A of the principal Regulations is amended —
(a)by deleting paragraph (3) and substituting the following paragraph:
(3)  Subject to paragraphs (3A), (7B) and (7E), the total value of all benefits which a dual status eligible member is entitled to receive in any relevant year shall be as follows:
(a)where he satisfies the requirement under regulation 4A(1)(d)(i)(A)(AA)(II) or (AB)(III) or (ii)(A)(AA)(II) or (AB)(III), the total value of all benefits which he is entitled to receive is as set out in —
(i)the table under paragraph 1 of the Sixth Schedule, if the relevant year is 2007, 2008 or 2009;
(ii)the table under paragraph 2 of the Sixth Schedule, if the relevant year is 2010; or
(iii)the table under paragraph 2B of the Sixth Schedule, if the relevant year is 2011 or any subsequent year;
(b)where he satisfies the requirement under regulation 4A(1)(d)(i)(A)(AA)(I) or (AB)(II) but fails to satisfy the requirement under regulation 4A(1)(d)(i)(A)(AA)(II) or (AB)(III) (as the case may be), or he satisfies the requirement under regulation 4A(1)(d)(ii)(A)(AA)(I) or (AB)(II) but fails to satisfy the requirement under regulation 4A(1)(d)(ii)(A)(AA)(II) or (AB)(III) (as the case may be), the total value of all benefits which he is entitled to receive is as set out in —
(i)the table under paragraph 1 of the Seventh Schedule, if the relevant year is 2007, 2008 or 2009;
(ii)the table under paragraph 2 of the Seventh Schedule, if the relevant year is 2010; or
(iii)the table under paragraph 2B of the Seventh Schedule, if the relevant year is 2011 or any subsequent year; or
(c)where he satisfies the requirement under regulation 4A(1)(d)(i)(A)(AB)(I) but fails to satisfy the requirements under regulation 4A(1)(d)(i)(A)(AB)(II) and (III), or he satisfies the requirement under regulation 4A(1)(d)(ii)(A)(AB)(I) but fails to satisfy the requirements under regulation 4A(1)(d)(ii)(A)(AB)(II) and (III), the total value of all benefits which he is entitled to receive is as set out in the table under paragraph 2C of the Seventh Schedule.”;
(b)by deleting the words “regulation 4A(1)(d)(i)(A)(AB) or (ii)(A)(AB)” in paragraph (3A)(a)(i) and substituting the words “regulation 4A(1)(d)(i)(A)(AA)(II) or (AB)(III) or (ii)(A)(AA)(II) or (AB)(III)”;
(c)by deleting sub-paragraph (i) of regulation (3A)(b) and substituting the following sub-paragraph:
(i)he satisfies the requirement under regulation 4A(1)(d)(i)(A)(AA)(I) but fails to satisfy the requirement under regulation 4A(1)(d)(i)(A)(AA)(II), or he satisfies the requirement under regulation 4A(1)(d)(ii)(A)(AA)(I) but fails to satisfy the requirement under regulation 4A(1)(d)(ii)(A)(AA)(II); and”;
(d)by deleting the words “paragraph (5)” in paragraph (4) and substituting the words “paragraphs (5) and (7C)”;
(e)by deleting the words “any subsequent year” in paragraphs (5) and (7) and substituting in each case “2011”;
(f)by deleting the words “, if the relevant year is 2010 or any subsequent year” in paragraph (5)(c);
(g)by inserting, immediately after the words “in a relevant year” in paragraph (6), the words “(being 2010 or 2011)”;
(h)by deleting the words “or any subsequent year” in paragraph (6)(b);
(i)by inserting, immediately after paragraph (7), the following paragraphs:
(7A)  A dual status eligible member is entitled to receive the benefits for any relevant quarter in 2012 or any subsequent year, if —
(a)he is a Singapore citizen, or becomes a Singapore citizen, on or before the last day of that relevant quarter; and
(b)he has worked as an employee for a period of at least 2 months in that relevant quarter.
(7B)  The value of the benefits which a dual status eligible member is entitled under paragraph (7A) to receive for each relevant quarter is as set out in the table under paragraph 2C of the Seventh Schedule.
(7C)  A dual status eligible member is entitled under paragraph (7A) —
(a)to receive the benefits for the first 3 relevant quarters in any relevant year (being 2012 or any subsequent year) before the end of the relevant year; and
(b)to receive the remainder of the benefits to which he is entitled in the relevant year (including the benefits for the fourth relevant quarter in the relevant year) as soon as practicable in the year immediately following the relevant year.
(7D)  A dual status eligible member is entitled to receive the benefits for any quarter (not being a relevant quarter) in 2012 or any subsequent year where he has worked as an employee in the last month of that quarter, if —
(a)he is a Singapore citizen, or becomes a Singapore citizen, on or before the last day of that quarter;
(b)he has worked as an employee for a period of at least 2 months in that quarter; and
(c)no part of that quarter forms any part of a relevant quarter for which the member is entitled under paragraph (7A) to receive any benefits.
(7E)  The value of the benefits which a dual status eligible member is entitled under paragraph (7D) to receive for each quarter is as set out in the table under paragraph 2C of the Seventh Schedule.”; and
(j)by deleting the words “paragraphs (1), (2), (3), (5) and (6)” in paragraph (8) and substituting the words “paragraphs (1), (2), (3), (5), (6) and (7A) to (7E)”.
Amendment of First Schedule
9.  The First Schedule to the principal Regulations is amended —
(a)by deleting the words “regulation 3(1)(d)(ii)” in paragraph 1 and substituting the words “regulation 3(1)(d)(i)(B)”;
(b)by deleting the words “regulation 3(1)(d)(ii)” in paragraph 2 and substituting the words “regulation 3(1)(d)(i)(B) or (ii)(C)”; and
(c)by inserting, immediately after the words “Attained 35 years of age but below 45 years of age” in the heading of the table under paragraph 2, the words “(if the member is not a specified member), or below 45 years of age (if the member is a specified member)”.
Amendment of Second Schedule
10.  The Second Schedule to the principal Regulations is amended —
(a)by deleting the words “REGULATION 5(2)(b)” in the Schedule heading and substituting the words “REGULATION 5(2)(b) or (c)”;
(b)by deleting the words “PROVISIONALLY IN RELEVANT YEAR” in the Schedule heading and substituting the words “UNDER REGULATION 5(4), (6A) OR (6D)”;
(c)by deleting the Schedule reference and substituting the following Schedule reference:
Regulation 5(2)(b) and (c), (5), (6B) and (6E)”;
(d)by deleting the words “regulation 3(1)(d)(i) but fails to satisfy the requirement under regulation 3(1)(d)(ii)” in paragraph 1 and substituting the words “regulation 3(1)(d)(i)(A) but fails to satisfy the requirement under regulation 3(1)(d)(i)(B)”;
(e)by deleting the words “regulation 3(1)(d)(i) but fails to satisfy the requirement under regulation 3(1)(d)(ii), and the value of benefits which an employed eligible member is entitled to receive provisionally in any relevant year” in paragraph 2 and substituting the words “regulation 3(1)(d)(i)(A) or (ii)(B) but fails to satisfy the requirement under regulation 3(1)(d)(i)(B) or (ii)(C) (as the case may be), and the value of benefits which an employed eligible member is entitled to receive provisionally in any relevant year (being 2010 or 2011)”;
(f)by inserting, immediately after the words “Attained 35 years of age but below 45 years of age” in the heading of the table under paragraph 2, the words “(if the member is not a specified member), or below 45 years of age (if the member is a specified member)”; and
(g)by inserting, immediately after paragraph 2, the following paragraph:
3.  The total value of all benefits which an employed eligible member is entitled to receive in any relevant year, where he satisfies the requirement under regulation 3(1)(d)(ii)(A) but fails to satisfy the requirements under regulation 3(1)(d)(ii)(B) and (C), and the value of the benefits which an eligible member is entitled to receive under regulation 5(6A) or (6D), shall be as set out in the following table, if the relevant year is 2012 or any subsequent year:

Amendment of Third Schedule
11.  The Third Schedule to the principal Regulations is amended —
(a)by deleting the words “regulation 4(1)(d)(i) or (ii)(B)” in paragraph 1 and substituting the words “regulation 4(1)(d)(i) or (ii)(A)(AB)”;
(b)by deleting the words “regulation 4(1)(d)(i) or (ii)(B)” in paragraph 2 and substituting the words “regulation 4(1)(d)(i) or (ii)(A)(AB) or (B)(BC)”; and
(c)by inserting, immediately after the words “Attained 35 years of age but below 45 years of age” in the heading of the table under paragraph 2, the words “(if the member is not a specified member), or below 45 years of age (if the member is a specified member)”.
Amendment of Fourth Schedule
12.  The Fourth Schedule to the principal Regulations is amended —
(a)by deleting the words “REGULATION 6(2)(b)” in the Schedule heading and substituting the words “REGULATION 6(2)(b) or (c)”;
(b)by deleting the Schedule reference and substituting the following Schedule reference:

(c)by deleting the words “regulation 4(1)(d)(ii)(A) but fails to satisfy the requirement under regulation 4(1)(d)(ii)(B)” in paragraph 1 and substituting the words “regulation 4(1)(d)(ii)(A)(AA) but fails to satisfy the requirement under regulation 4(1)(d)(ii)(A)(AB)”;

Amendment of Fifth Schedule
13.  The Fifth Schedule to the principal Regulations is amended by deleting the words “any subsequent year” in paragraph 2 and substituting “2011”.
Amendment of Sixth Schedule
14.  The Sixth Schedule to the principal Regulations is amended —
(a)by deleting the words “regulation 4A(1)(d)(i)(A)(AB) or (ii)(A)(AB)” in paragraphs 1, 2 and 2A and substituting in each case the words “regulation 4A(1)(d)(i)(A)(AA)(II) or (ii)(A)(AA)(II)”;
(b)by deleting the words “regulation 4A(1)(d)(i)(A)(AB) or (ii)(A)(AB)” in paragraph 2B and substituting the words “regulation 4A(1)(d)(i)(A)(AA)(II) or (AB)(III) or (ii)(A)(AA)(II) or (AB)(III)”; and
(c)by inserting, immediately after the words “Attained 35 years of age but below 45 years of age” in the heading of the table under paragraph 2B, the words “(if the member is not a specified member), or below 45 years of age (if the member is a specified member)”.
Amendment of Seventh Schedule
15.  The Seventh Schedule to the principal Regulations is amended —
(a)by deleting the words “REGULATION 6A(3)(b)” in the Schedule heading and substituting the words “REGULATION 6A(3)(b) or (c)”;
(b)by deleting the words “PROVISIONALLY IN RELEVANT YEAR” in the Schedule heading and substituting the words “UNDER REGULATION 6A(5), (7A) OR (7D)”;
(c)by deleting the Schedule reference and substituting the following Schedule reference:

2C.  The total value of all benefits which a dual status eligible member is entitled to receive in any relevant year, where he satisfies the requirement under regulation 4A(1)(d)(i)(A)(AB)(I) but fails to satisfy the requirements under regulation 4A(1)(d)(i)(A)(AB)(II) and (III), or satisfies the requirement under regulation 4A(1)(d)(ii)(A)(AB)(I) but fails to satisfy the requirements under regulation 4A(1)(d)(ii)(A)(AB)(II) and (III), and the value of the benefits which a dual status eligible member is entitled to receive under regulation 6A(7A) or (7D), shall be as set out in the following table, if the relevant year is 2012 or any subsequent year:
