(Excluded Election Advertising)
Notification 2017
In exercise of the powers conferred by the definition of “election advertising” in section 2(1) of the Presidential Elections Act, the Prime Minister makes the following Notification:
Citation and commencement
1.  This Notification is the Presidential Elections (Excluded Election Advertising) Notification 2017 and comes into operation on 1 June 2017.
Definitions
2.  In this Notification, unless the context otherwise requires —
“impermissible content” means any message, picture or image, or any explicit or implicit reference or comment, that —
(a)is a false statement of fact in relation to the personal character or conduct of an identifiable candidate in an election; and
(b)can reasonably be regarded as intended to affect the return of the candidate at, or the standing of the candidate with the electorate in connection with, the election;
“value”, in relation to any thing, means the price which that thing might reasonably be expected to fetch on a sale in the open market.
Things excluded from being election advertising
3.  Each of the following things is not election advertising for the purposes of the Act if the thing does not contain or display any impermissible content:
(a)a diary or calendar on paper or paperboard;
(b)a key chain;
(c)a T-shirt or any other article of apparel;
(d)an article in the nature of dress or clothing accessory, such as a lapel pin, tie, scarf, cap or hat;
(e)a retail packet or package containing cleansing tissue paper or paper napkins that have been cut to size;
(f)a miniature flag or pennant;
(g)a soft toy;
(h)an umbrella;
(i)an inflatable object;
(j)any other portable object or article (not being a decalcomania or any other adhesive label) —
(i)the value of which is less than $10; and
(ii)which can fit into a space measuring 10 centimetres by 10 centimetres by 10 centimetres.
Cancellation
4.  The Presidential Elections (Excluded Election Advertising) Notification 2011 (G.N. No. S 444/2011) is cancelled.
