Parking Places (Amendment) Act 2018
(Saving and Transitional) (No. 2)
Regulations 2018
In exercise of the powers conferred by section 23(5) of the Parking Places (Amendment) Act 2018, the Minister for Transport makes the following Regulations:
Citation and commencement
1.  These Regulations are the Parking Places (Amendment) Act 2018 (Saving and Transitional) (No. 2) Regulations 2018 and come into operation on 8 May 2018.
Definitions
2.  In these Regulations, unless the context otherwise requires —
“amended Act” means the Parking Places Act (Cap. 214) as amended by the Parking Places (Amendment) Act 2018;
“appointed day” means —
(a)1 May 2018, for the purposes of regulation 3; and
(b)8 May 2018, for the purposes of all other regulations;
“previous Act” means the Parking Places Act as in force immediately before the relevant appointed day;
“Superintendent” has the meaning given by section 2 of the amended Act.
Saving of parking charges prescribed under previous Act
3.—(1)  Every charge prescribed under section 9 of the previous Act for any parking place and in force immediately before the appointed day is deemed to be a parking charge fixed by the Superintendent for that parking place under section 9 of the amended Act.
(2)  In this regulation —
“parking charge” includes a reference to a season parking charge;
“Superintendent” includes the meaning given by section 9(8) of the amended Act.
Waivers under previous Act, etc.
4.  For the purposes of section 6A(2) of the amended Act, every waiver by the Authority that —
(a)is granted before the appointed day, under the Parking Places (Provision of Parking Places and Parking Spaces) Rules (R 5) as in force before that day; and
(b)is in force on that day,
is, so far as it is not inconsistent with the provisions of the amended Act, to continue as if, and is deemed to be, a waiver granted by the Authority under the amended Act.
Pending applications for approval or waiver
5.  Where —
(a)an application or other document is lodged for approval or waiver under the Parking Places (Provision of Parking Places and Parking Spaces) Rules (R 5) before the appointed day; and
(b)the application or other document was not withdrawn and yet not approved by the Authority before that day,
the application or other document is, where applicable, to be treated as an application or a document lodged for approval or waiver with the Authority under the amended Act and those Rules as in force on or after the appointed day, and anything started by the Authority in connection with such an application or a document may be carried on and completed by the Authority under the amended Act and those Rules.
Deemed applicable requirements
6.  For the purposes of section 6A(2) of the amended Act, every proposal and plan for the provision of parking places and parking spaces that —
(a)is lodged or approved by the Authority under the Parking Places (Provision of Parking Places and Parking Spaces) Rules (R 5) before the appointed day; and
(b)is in force on that day,
is to continue as if, and is deemed to be, a proposal or plan for the provision of parking lots approved by the Authority under the amended Act.
Revocation
7.  The Parking Places (Amendment) Act 2018 (Saving and Transitional) Regulations 2018 (G.N. No. S 259/2018) are revoked.
