(Development and Building Works in
Railway Corridor and Railway Protection Zone)
(Amendment) Regulations 2023

In exercise of the powers conferred by section 45 of the Rapid Transit Systems Act 1995, the Land Transport Authority of Singapore, with the approval of the Minister for Transport, makes the following Regulations:

Citation and commencement

1.—(1) These Regulations are the Rapid Transit Systems (Development and Building Works in Railway Corridor and Railway Protection Zone) (Amendment) Regulations 2023 and, except for regulation 5, come into operation on 1 June 2023.

(2) Regulation 5 is deemed to have come into operation on 31 December 2021.

Amendment of regulation 12

2. In the Rapid Transit Systems (Development and Building Works in Railway Corridor and Railway Protection Zone) Regulations 2021 (G.N. No. S 712/2021) (called in these Regulations the principal Regulations), in regulation 12, replace “the Schedule” with “the First Schedule”.

New regulation 19A

3. In the principal Regulations, after regulation 19, insert —

“Fees

19A.—(1) The fees specified in the Second Schedule are payable to the Authority in respect of the matters specified in that Schedule.

(2) The Authority may, in any particular case or class of cases, waive, reduce or refund the whole or any part of any fee paid or payable under these Regulations.”.

Renaming of Schedule and new Second Schedule

4. In the principal Regulations —

(a)

rename the Schedule as the First Schedule; and

(b)

after the First Schedule, insert —

“SECOND SCHEDULE

Regulation 19A(1)

Fees

1.	Fee for submission of any declaration, information, instrument, plan or document for the purpose of an application under regulation 4, 5, 6 or 10 —

(a)	for the first, second or third submission of the declaration, information, instrument, plan or document in respect of that application; or

Nil

(b)	for the fourth or each subsequent submission of the declaration, information, instrument, plan or document in respect of that application.

Miscellaneous amendments

5. In the principal Regulations —

(a)

in regulation 2, in the definition of “building works”, replace “(Cap. 29)” with “1989”;

(b)

in regulation 2, in the definition of “Commissioner of Building Control”, after “Building Control Act”, insert “1989”;

(c)

in regulation 2, in the definition of “development”, replace “(Cap. 232)” with “1998”;

(d)

in regulation 2, in the definition of “provisional permission”, after “Planning Act”, insert “1998”;

(e)

in regulation 2, in the definition of “qualified person”, after “Building Control Act”, insert “1989”;

(f)

in regulation 2, in the definition of “written permission”, after “Planning Act”, insert “1998”;

(g)

in the following provisions, after “Planning Act”, insert “1998”:

Regulation 4(1)(b) and (c)(vi)

Regulation 10(1)(b)(i);

(h)

in regulation 5(1)(b), after “Building Control Act”, insert “1989”;

(i)

in regulation 11(1)(a), replace “(Cap. 253)” with “1991”;

(j)

in regulation 11(1)(b)(i)(A), replace “(Cap. 12)” with “1991”; and

(k)

in regulation 11(1)(b)(i)(B) and (ii), after “Professional Engineers Act”, insert “1991”.
