Planning (Development Charges) (Amendment No. 2) Rules 2009
In exercise of the powers conferred by section 40(1) of the Planning Act, the Minister for National Development hereby makes the following Rules:
Citation and commencement
1.  These Rules may be cited as the Planning (Development Charges) (Amendment No. 2) Rules 2009 and shall come into operation on 7th July 2009.
Amendment of rule 9
2.  Rule 9 of the Planning (Development Charges) Rules (R 5) is amended —
(a)by deleting the words “paragraph (a)” in paragraph (b) and substituting the words “sub-paragraph (a)”;
(b)by deleting the words “rule 4(b)” in paragraphs (b) and (c) and substituting in each case the words “rule 4(1)(b)”; and
(c)by renumbering the rule as paragraph (1) of that rule, and by inserting immediately thereafter the following paragraph:
(2)  Notwithstanding paragraph (1)(c), where —
(a)the land is zoned in the Master Plan for any of the purposes set out in the first column of the table in the Third Schedule; and
(b)at least one of the 2 or more purposes for which the land or any building thereon is intended to be developed is a White use,
then, in determining the Development Ceiling properly attributable to any floor of any building which is intended to be used as service areas serving the various purposes for which the land is to be developed, B2 in the formula specified in rule 4(1)(b) shall be determined in accordance with the formula set out in the second column of the table in the Third Schedule.”.
New Third Schedule
3.  The Planning (Development Charges) Rules are amended by inserting, immediately after the Second Schedule, the following Schedule:

Rule 9(2)
Formula to Determine B2 for Certain Developments
UNKNOWN
For the purpose of the formula to determine B2 in the table above —
(a)P is the total floor area of the service areas;
(b)where the purposes for which the land or any building thereon is intended to be developed include only one type of White use, K1 is the rate corresponding to both the appropriate geographical sector of the land and the Use Group within which the type of White use falls;
(c)where the purposes for which the land or any building thereon is intended to be developed include more than one type of White use, K1 is the average of the rates corresponding to both the appropriate geographical sector of the land and the various Use Groups within which such types of White uses fall; and
(d)K2 is the rate corresponding to both the appropriate geographical sector of the land and Use Group D.”.
