Public Utilities (Water Supply)
(Amendment) Regulations 2020
In exercise of the powers conferred by section 72 of the Public Utilities Act, the Public Utilities Board, with the approval of the Minister for the Environment and Water Resources, makes the following Regulations:
Citation and commencement
1.  These Regulations are the Public Utilities (Water Supply) (Amendment) Regulations 2020 and come into operation on 30 April 2020.
Amendment of regulation 2
2.  Regulation 2 of the Public Utilities (Water Supply) Regulations (Rg 5) (called in these Regulations the principal Regulations) is amended —
(a)by inserting, immediately after the definition of “NEWater”, the following definition:
“ “PUB S&R Standard” means the document known as “PUB’s Stipulation of Standards & Requirements for Water Fittings for Use in Potable Water Service Installations” published by the Board, as in force from time to time;”; and
(b)by deleting the definition of “Singapore Standard”.
Deletion of regulation 3
3.  Regulation 3 of the principal Regulations is deleted.
Amendment of regulation 5
4.  Regulation 5 of the principal Regulations is amended — 
(a)by deleting paragraph (2) and substituting the following paragraph:
(2)  For the purposes of paragraph (1)(a), a water fitting is of an appropriate quality and standard only if it conforms to every requirement applicable to it specified in the PUB S&R Standard.”;
(b)by deleting the words “paragraph (2)(a)” in paragraph (3) and substituting the words “paragraph (2)”;
(c)by deleting the words “with a standard stipulated by the Board if it is certified or tested as complying with such standard” in paragraph (3) and substituting the words “to the applicable requirements mentioned in that paragraph if the water fitting is certified or tested as conforming to those applicable requirements”; and
(d)by deleting paragraph (4).
Amendment of regulation 8
5.  Regulation 8(1) of the principal Regulations is amended —
(a)by inserting the word “and” at the end of sub‑paragraph (i)(A);
(b)by deleting sub‑paragraph (C) of sub‑paragraph (i); and
(c)by deleting the words “regulation 5(2)(a) or (4)” in sub‑paragraph (ii) and substituting the words “regulation 5(2)”.
Amendment of regulation 14
6.  Regulation 14 of the principal Regulations is amended —
(a)by deleting paragraphs (2) and (3) and substituting the following paragraph:
(2)  Any consumer who contravenes paragraph (1) shall be guilty of an offence.”;
(b)by deleting the words “Paragraphs (1) and (2)” in paragraph (4) and substituting the words “Paragraph (1)”; and
(c)by deleting the words “and security” in the regulation heading.
Amendment of regulation 18
7.  Regulation 18 of the principal Regulations is amended —
(a)by deleting paragraph (2) and substituting the following paragraph:
(2)  For the purposes of paragraph (1)(a), a water fitting is of an appropriate quality and standard only if it conforms to every requirement applicable to it specified in the PUB S&R Standard.”;
(b)by deleting the words “paragraph (2)(a)” in paragraph (3) and substituting the words “paragraph (2)”;
(c)by deleting the words “with a standard stipulated by the Board if it is certified or tested as complying with such standard” in paragraph (3) and substituting the words “to the applicable requirements mentioned in that paragraph if the water fitting is certified or tested as conforming to those applicable requirements”; and
(d)by deleting paragraph (4).
Amendment of regulation 24
8.  Regulation 24 of the principal Regulations is amended —
(a)by deleting paragraph (3); and
(b)by deleting the words “and security” in the regulation heading.
Amendment of regulation 29
9.  Regulation 29(1) of the principal Regulations is amended —
(a)by inserting the word “and” at the end of sub‑paragraph (c)(i);
(b)by deleting sub‑paragraph (iii) of sub‑paragraph (c); and
(c)by deleting the words “regulation 18(2)(a) or (4)” in sub‑paragraph (d) and substituting the words “regulation 18(2)”.
Amendment of regulation 36
10.  Regulation 36 of the principal Regulations is amended by deleting paragraph (1) and substituting the following paragraph:
(1)  Every meter in relation to water supplied by the Board is to be fixed and maintained by the Board.”.
Amendment of regulation 38
11.  Regulation 38 of the principal Regulations is amended —
(a)by inserting, immediately after the words “such times” in paragraph (1), the words “and in such manner”;
(b)by deleting paragraph (2) and substituting the following paragraph:
(2)  The Board or the agent of the Board may make a fair and reasonable estimate of the bill that must be paid by the consumer for water consumed for the month if a meter reading cannot be obtained from any meter in the premises of the consumer because of —
(a)any obstruction or hindrance to a meter reader’s access to the meter; or
(b)any malfunction or failure of the meter.”; and
(c)by deleting the words “the meter of the consumer has been read by the meter reader” in paragraph (4) and substituting the words “practicable after a meter reading is obtained from the meter of the consumer”.
Deletion and substitution of regulation 41 and new regulation 41A
12.  Regulation 41 of the principal Regulations is deleted and the following regulations substituted therefor:
Board may waive requirements
41.  The Board or an authorised officer may, in any particular case, waive any requirement specified in —
(a)these Regulations; or
(b)any material (as defined in section 72A(1) of the Act) applied, adopted or incorporated by reference in these Regulations,
to the extent that the Board or the authorised officer (as the case may be) thinks fit in all the circumstances of the case.
Person responsible for security of water service installation having certain storage tank
41A.  For the purpose of section 45A of the Act, the person responsible for the security of a water service installation having a storage tank from which piped water suitable for drinking (excluding NEWater) is drawn, is —
(a)in relation to every water service installation used for the supply of water by the Board — a consumer responsible for the maintenance of any part of a water service installation mentioned in regulation 13(2)(b); and
(b)in relation to every water service installation used for the supply of water by an approved person — the approved person.”.
Amendment of First Schedule
13.  Paragraph 16(2) of the First Schedule to the principal Regulations is amended by deleting the words “Singapore Standard CP 48 — Code of Practice for Water Services” and substituting the words “Singapore Standard SS 636 : 2018 known as “Code of practice for water services” published by the Enterprise Singapore Board, as in force from time to time,”.
Amendment of Second Schedule
14.  Part 1 of the Second Schedule to the principal Regulations is amended by deleting the definition of “SS” in paragraph 5 and substituting the following definition:
“ “SS” means a standard or specification published by the Enterprise Singapore Board.”.
Miscellaneous amendments
15.  The principal Regulations are amended —
(a)by deleting the words “any standard, code of practice or guidelines adopted or issued by the Board under regulation 3” in the following provisions and substituting in each case the words “the PUB S&R Standard”:
Regulations 4(1)(c), 13(3)(a), 17(1)(e), 23(2)(a) and 26(1)(c); and
(b)by deleting the words “, the First Schedule or any standard, code of practice or guidelines adopted or issued by the Board under regulation 3” in the following provisions and substituting in each case the words “or the First Schedule”:
Regulations 4(2)(c), 17(2)(c) and 26(2)(c).
