(Exemption) Order 2019
In exercise of the powers conferred by section 10 of the Smoking (Prohibition in Certain Places) Act, the National Environment Agency, with the approval of the Minister for the Environment and Water Resources, makes the following Order:
Citation
1.  This Order is the Smoking (Prohibition in Certain Places) (Tax Free World Association Asia Pacific Exhibition and Conference 2019) (Exemption) Order 2019.
Definitions
2.—(1)  In this Order —
“2019 exhibition” means the Tax Free World Association Asia Pacific Exhibition and Conference 2019 held in Singapore during the exhibition period;
“disposal receptacle” has the meaning given by regulation 2 of the Smoking (Prohibition in Certain Places) Regulations 2018 (G.N. No. S 867/2018);
“exhibition period”, in relation to the 2019 exhibition, means the period starting on 14 May 2019 and ending on 16 May 2019;
“exhibition venue” means the Sands Expo and Convention Centre, Marina Bay Sands, at which the 2019 exhibition is held;
“registered trade visitor” means a person who is registered to participate in or visit the 2019 exhibition;
“relevant specified place” means the specified place mentioned in paragraph 15 of Part 5 of the First Schedule to the Smoking (Prohibition in Certain Places) Regulations 2018;
“representative”, in relation to a tobacco exhibitor, means an employee, officer or agent of the tobacco exhibitor who participates in the 2019 exhibition on behalf of that exhibitor;
“tobacco exhibitor” means a participant in the 2019 exhibition specified in the Schedule.
(2)  For the purposes of this Order, any reference to an individual who smokes is a reference to an individual who smokes a tobacco product, or a sample of a tobacco product, provided within the exhibition venue by a tobacco exhibitor during the exhibition period.
Exemption for registered trade visitor
3.—(1)  The prohibition under section 3(1) of the Act against smoking in the relevant specified place does not apply to a registered trade visitor who smokes within the exhibition venue during the exhibition period, if all the conditions in sub‑paragraph (2) are satisfied.
(2)  The conditions are as follows:
(a)the individual’s registration as a registered trade visitor is verified by a representative of a tobacco exhibitor before he or she enters an enclosed room mentioned in sub‑paragraph (b);
(b)the registered trade visitor smokes in an enclosed room within the exhibition venue that —
(i)is independently ventilated;
(ii)is visible, and accessible, only to registered trade visitors and representatives of the tobacco exhibitor; and
(iii)contains one or more disposal receptacles;
(c)the registered trade visitor is accompanied by a representative of the tobacco exhibitor when he or she smokes in the enclosed room.
Exemption for representative of tobacco exhibitor
4.  The prohibition under section 3(1) of the Act against smoking in the relevant specified place does not apply to a representative of a tobacco exhibitor who smokes within the exhibition venue during the exhibition period, if the representative smokes in the enclosed room mentioned in paragraph 3(2)(b) with a registered trade visitor exempt under paragraph 3(1).
