Biological Agents and Toxins Act
(Amendment of First, Second,
Fifth and Eighth Schedules)
Order 2015

In exercise of the powers conferred by section 62 of the Biological Agents and Toxins Act, the Minister for Health makes the following Order:

Citation and commencement

1. This Order may be cited as the Biological Agents and Toxins Act (Amendment of First, Second, Fifth and Eighth Schedules) Order 2015 and comes into operation on 1 July 2015.

Amendment of Part I of First Schedule

2. Part I of the First Schedule to the Biological Agents and Toxins Act (referred to in this Order as the principal Act) is amended —

(a)

by inserting, immediately after item 4 under the heading “FUNGI”, the following items:

“4A.	Coccidioides immitis

4B.

Coccidioides posadasii, except for the following attenuated strains:

(a)	∆chs5; and
(b)	∆cts2/∆ard1/∆cts3”;

(b)

by inserting, immediately after paragraph (c) of item 1 under the heading “VIRUSES”, the following paragraph:

“(d)	Flexal virus”;

(c)

by deleting the words “(except Hantaan, Seoul and Sin Nombre)” in item 2(d) under the heading “VIRUSES”; and

(d)

by inserting, immediately after paragraph (c) of item 5 under the heading “VIRUSES”, the following paragraph:

“(d)	Influenza A virus subtype H7N9”.

Amendment of Part II of First Schedule

3. Part II of the First Schedule to the principal Act is amended —

(a)

by deleting the heading “FUNGI” and items 1, 2 and 3 under that heading;

(b)

by deleting item 1 under the heading “VIRUSES”;

(c)

by deleting paragraphs (a), (b) and (c) of item 2 under the heading “VIRUSES”; and

(d)

by deleting paragraph (a) of item 3 under the heading “VIRUSES” and substituting the following paragraphs:

“(a)	Middle East Respiratory Syndrome Coronavirus (MERS CoV)
(b)	Severe Acute Respiratory Syndrome Coronavirus (SARS CoV), formerly known as SARS Coronavirus”.

Amendment of Second Schedule

4. The Second Schedule to the principal Act is amended by inserting, immediately after item 15, the following items:

“15A.

Lujo virus

15B.	Chapare virus”.

Amendment of Fifth Schedule

5. The Fifth Schedule to the principal Act is amended by deleting item 3 and substituting the following item:

“3. Staphylococcal Enterotoxins”.

Deletion and substitution of Eighth Schedule

6. The Eighth Schedule to the principal Act is deleted and the following Schedule substituted therefor:

“EIGHTH SCHEDULE

Section 59(1)

Non-compoundable Offences

1. An offence under section 5 or 30 is not compoundable under section 59.”.
