Road Traffic (Carriage of Persons in Goods Vehicles) (Consolidation) (Amendment) Rules 2009
In exercise of the powers conferred by section 77(6) of the Road Traffic Act, the Land Transport Authority of Singapore hereby makes the following Rules:
Citation and commencement
1.  These Rules may be cited as the Road Traffic (Carriage of Persons in Goods Vehicles) (Consolidation) (Amendment) Rules 2009 and shall come into operation on 1st September 2009.
New rule 3
2.  The Road Traffic (Carriage of Persons in Goods Vehicles) (Consolidation) Rules (R 1) (referred to in these Rules as the principal Rules) are amended by inserting, immediately after rule 2, the following rule:
Prohibition of persons to be carried on floor of vehicle unless all passenger seats have been filled up
3.  Subject to rules 4A(1) and 7(2), no person shall be carried on the floor of a goods vehicle which has an open deck for the carriage of goods, whether such person is seated or otherwise, unless every passenger seat provided in the driver’s cabin, or any additional cabin or enclosed space provided for the carriage of passengers or goods and which is adjacent to or is an extension of the cabin for the driver, is filled up.”.
Deletion and substitution of rule 4 and new rule 4A
3.  Rule 4 of the principal Rules is deleted and the following rules substituted therefor:
Safety of persons carried in goods vehicles
4.—(1)  No passenger shall, while being carried on or being permitted to ride on a goods vehicle, allow any part of his body to project beyond the side of the vehicle.
(2)  Subject to rule 6, no person shall drive, or cause or permit a person to drive, a goods vehicle while any person is standing in it.
(3)  No person shall drive, or cause or permit a person to drive, a goods vehicle which is carrying any load if the load is in such position that danger is likely to be caused to any passenger riding on the goods vehicle by reason of the load of any part thereof falling onto the passenger.
(4)  No person shall drive, or cause or permit a person to drive, a goods vehicle which has no open deck for the carriage of goods while carrying any passengers seated in or on any part of the vehicle if the height of the passenger, when sitting, exceeds 3.2 metres from the road surface upon which the goods vehicle rests.
(5)  No owner of a goods vehicle shall allow the goods vehicle to be driven in contravention of paragraph (2), (3) or (4).
Height restriction for persons carried on open deck goods vehicle
4A.—(1)  No person shall drive, or cause or permit a person to drive, a goods vehicle which has an open deck for the carriage of goods if the height of the passenger, when sitting, exceeds 1.1 metres from the deck of the vehicle.
(2)  No owner of a goods vehicle shall allow the goods vehicle to be driven in contravention of paragraph (1).”.
Deletion and substitution of rule 7
4.  Rule 7 of the principal Rules is deleted and the following rule substituted therefor:
Computation of number of persons carried
7.—(1)  In the case of any goods vehicle which has no open deck for the carriage of goods, no person shall drive, or cause or permit a person to drive, a goods vehicle carrying passengers if the clear floor space of the deck available for each passenger is less than 0.372 square metres.
(2)  In the case of any goods vehicle which has an open deck for the carriage of goods, no person shall drive, or cause or permit a person to drive, a goods vehicle carrying passengers if the clear floor space of the open deck available for each passenger is less than —
(a)0.372 square metres, for the period between 1st September 2009 and 31st August 2012 (both dates inclusive); and
(b)0.744 square metres, for the period on or after 1st September 2012.
(3)  No owner of a goods vehicle shall allow the goods vehicle to be driven in contravention of paragraph (1) or (2).”.
Amendment of rule 8
5.  Rule 8 of the principal Rules is amended by deleting paragraph (2) and substituting the following paragraph:
(2)  The marking or label referred to in paragraph (1) shall —
(a)in the case of a goods vehicle which has an open deck for the carriage of goods —
(i)conform to the specifications set out in Diagram 1 of the Schedule if the vehicle is registered before 1st January 2010 but is used for the carriage of passengers between 1st September 2009 and 31st August 2012 (both dates inclusive);
(ii)conform to the specifications set out in Diagram 2 of the Schedule if the vehicle is registered before 1st January 2010 but is used for the carriage of passengers on or after 1st September 2012; or
(iii)conform to the specifications set out in Diagram 2 of the Schedule if the vehicle is registered on or after 1st January 2010 and is used for the carriage of passengers; and
(b)in the case of any other goods vehicle, conform to the specifications set out in Diagram 1 of the Schedule.”.
Deletion and substitution of Schedule
6.  The Schedule to the principal Rules is deleted and the following Schedule substituted therefor:
