Environmental Protection and Management Act
(Chapter 94A)
Environmental Protection and Management Act (Amendment of Second Schedule) Order 2008
In exercise of the powers conferred by section 76(1) of the Environmental Protection and Management Act, the Minister for the Environment and Water Resources hereby makes the following Order:
Citation and commencement
1.  This Order may be cited as the Environmental Protection and Management Act (Amendment of Second Schedule) Order 2008 and shall come into operation on 31st January 2008.
Amendment of Second Schedule
2.  The Second Schedule to the Environmental Protection and Management Act is amended —
(a)by inserting, immediately above the item “Acetic acid” in Part I, the following item:
1,2-dibromoethane (EDB)
 
(b)by inserting, immediately below the item “Acetic acid” in Part I, the following items:
Acetyl bromide
 
Allyl isothiocyanate
 
(c)by inserting, immediately below the item “Antimony pentachloride” in Part I, the following item:
Antimony trihydride
 
(d)by deleting the item “Asbestos in the form of crocidolite, amosite, chrysotile and amphiboles and products containing these forms of asbestos” in Part I and substituting the following item:
Asbestos in the form of crocidolite, actinolite, anthophyllite, amosite, tremolite, chrysotile and amphiboles and products containing these forms of asbestos
 
Asbestos in the form of chrysotile in any vehicle brake or clutch lining installed in any vehicle registered before 1st April 1995.
(e)by inserting, immediately below the item “Boric acid; Sodium borate” in Part I, the following item:
Boron tribromide
 
(f)by inserting, immediately below the item “Carbamates” in Part I, the following item:
Carbon monoxide
 
Gas mixtures containing carbon monoxide weighing less than 1 metric tonne;
 
 
Gas mixtures containing carbon monoxide as by-products from combustion activities.
(g)by inserting, immediately after the item “Chlordecone” under the substance “Chlorinated hydrocarbons, the following:” in Part I, the following item:
Chlordimeform”;
(h)by deleting the item “Gamma benzene hexachloride (Gamma — BHC)” under the substance “Chlorinated hydrocarbons, the following:” in Part I and substituting the following items:
“Gamma benzene hexachloride (Gamma — BHC), also known as lindane
HCH (mixed isomers)”;
(i)by inserting, immediately after the item “Heptachlor” under the substance “Chlorinated hydrocarbons, the following:” in Part I, the following item:
“Hexachloroethane”;
(j)by inserting, immediately after the item “Methoxychlor [1, 1, 1-trichloro-2, 2-di-(p-methoxyphenyl) ethane]” under the substance “Chlorinated hydrocarbons, the following:” in Part I, the following item:
“Mirex”;
(k)by deleting the item “Pentachlorophenol and their salts” under the substance “Chlorophenols, the following:” in Part I and substituting the following item:
“Pentachlorophenol and its salts and esters”;
(l)by deleting the item “Chlorophenoxyacids; their salts, esters, amines” in Part I and substituting the following item:
Chlorophenoxyacids; their salts, esters, amines, which include but are not limited to —
 
2,4,5-T and its salts and esters
 
(m)by deleting the item “Dinitrocresols (DNOC); their compounds with a metal or a base” in Part I and substituting the following item:
Dinitro-ortho-cresol (DNOC) and its salts (such as ammonium salt, potassium salt and sodium salt)"
 
(n)by deleting the item “Dinoseb; its compounds with a metal or a base” in Part I and substituting the following item:
Dinoseb and its salts and esters, which includes but is not limited to —

(o)by inserting, immediately below the item “Drazoxolon; its salts” in Part I, the following item:
Dustable powder formulations containing a combination of —
 
benomyl at or above 7 per cent, carbofuran at above 10 per cent, thiram at or above 15 per cent
 
(p)by deleting the item “Ethylene dibromide” in Part I;
(q)by inserting, immediately below the item “Ferric chloride” in Part I, the following item:
Fipronil
 
Formulated products containing Fipronil approved for household use and belonging to the WHO Class IV hazards.
(r)by deleting the item “Lead tetra-ethyl and similar lead containing compounds” in Part I;
(s)by deleting the item “Mercuric chloride; Mercuric iodide; Organic compounds of mercury” in Part I and substituting the following item:
Mercury compounds including inorganic mercury compounds, alkyl mercury compounds, alkyloxyalkyl and aryl mercury compounds, and other organic compounds of mercury
 
(t)by inserting, immediately below the item “Monomethyl-dibromodiphenyl methane” in Part I , the following item:
Neonicotinoid compounds used as pesticides, the following:
 
 
Imidacloprid
 
Formulated products containing Imidacloprid approved for household use and belonging to the WHO Class IV hazards.
(u)by inserting, immediately after the item “Cyhexatin” under the substance “Organo-tin compounds, the following:” in Part I, the following item:
“Tributyl tin compounds”;
(v)by inserting, immediately below the item “Perchloromethyl mercaptan” in Part I, the following item:
Perfluorooctane sulfonate (PFOS)
 
(w)by deleting the item “Phosphorus compounds used as pesticides (insecticides, acaricides, etc.)” in Part I and substituting the following item:
Phosphorus compounds used as pesticides (insecticides, acaricides, etc.), which includes but is not limited to:
Methamidophos
Methyl-parathion
Monocrotophos
Acephate;
 
Bromophos;
Iodofenphos;
Malathion;
Pirimiphos-methyl;
Temephos;
Parathion
Phosphamidon
Tetrachlorvinphos;
Trichlorfon;
Preparations containing not more than 0.5%, weight in weight, of chlorpyrifos and not containing any other phosphorus compound;
Preparations containing not more than 0.5%, weight in weight, of dichlorvos and not containing any other phosphorus compound;
Materials impregnated with dichlorvos and not containing any other phosphorus compound for slow release;
Preparations containing not more than 1%, weight in weight, of azamethiphos and not containing any other phosphorus compound.
