Protection from Online Falsehoods and
Manipulation (Amendment No. 2)
Regulations 2020
In exercise of the powers conferred by section 62 of the Protection from Online Falsehoods and Manipulation Act 2019, the Minister for Communications and Information makes the following Regulations:
Citation and commencement
1.  These Regulations are the Protection from Online Falsehoods and Manipulation (Amendment No. 2) Regulations 2020 and come into operation on 3 June 2020.
Amendment of regulation 3
2.  Regulation 3(3) of the Protection from Online Falsehoods and Manipulation Regulations 2019 (G.N. No. S 662/2019) (called in these Regulations the principal Regulations) is amended —
(a)by inserting the word “and” at the end of sub‑paragraph (b)(ii);
(b)by deleting the word “and” at the end of sub‑paragraph (b)(iii);
(c)by deleting sub‑paragraph (iv) of sub‑paragraph (b); and
(d)by inserting, immediately after sub‑paragraph (b), the following sub‑paragraph:
(ba)WhatsApp Inc., in respect of WhatsApp;”.
Amendment of regulation 9
3.  Regulation 9(1) of the principal Regulations is amended —
(a)by deleting sub‑paragraphs (a) and (b) and substituting the following sub‑paragraphs:
(a)by giving a copy of the document —
(i)in the case of a body corporate (including a limited liability partnership) or an unincorporated association, to the secretary or other like officer of the body corporate or unincorporated association, or the limited liability partnership’s manager;
(ii)in the case of an individual, to the individual; or
(iii)in the case of a partnership (other than a limited liability partnership), to any partner or other like officer of the partnership;
(b)by leaving a copy of the document —
(i)in the case of an individual, at the individual’s usual or last known place of residence with an adult apparently resident there, or at the individual’s business address with an adult apparently employed there; or
(ii)in the case of a person other than an individual, at the person’s business address;
(ba)if the person is an individual, by affixing a copy of the document in a conspicuous place at the individual’s usual or last known place of residence or at the individual’s business address;”; and
(b)by inserting, immediately before the words “registered post” in sub‑paragraphs (c) and (g)(ii), the words “ordinary or”.
Amendment of regulation 10
4.  Regulation 10(1) of the principal Regulations is amended —
(a)by deleting sub‑paragraphs (a) and (b) and substituting the following sub‑paragraphs:
(a)by giving a copy of the document —
(i)in the case of a body corporate (including a limited liability partnership) or an unincorporated association, to the secretary or other like officer of the body corporate or unincorporated association, or the limited liability partnership’s manager;
(ii)in the case of an individual, to the individual; or
(iii)in the case of a partnership (other than a limited liability partnership), to any partner or other like officer of the partnership;
(b)by leaving a copy of the document —
(i)in the case of an individual, at the individual’s usual or last known place of residence with an adult apparently resident there, or at the individual’s business address with an adult apparently employed there; or
(ii)in the case of a person other than an individual, at the person’s business address;
(ba)if the person is an individual, by affixing a copy of the document in a conspicuous place at the individual’s usual or last known place of residence or at the individual’s business address;”; and
(b)by inserting, immediately before the words “registered post” in sub‑paragraphs (c) and (e)(ii), the words “ordinary or”.
Amendment of regulation 11
5.  Regulation 11(1) of the principal Regulations is amended —
(a)by deleting sub‑paragraphs (a) and (b) and substituting the following sub‑paragraphs:
(a)by giving a copy of the Declaration or notice —
(i)in the case of a body corporate (including a limited liability partnership) or an unincorporated association, to the secretary or other like officer of the body corporate or unincorporated association, or the limited liability partnership’s manager;
(ii)in the case of an individual, to the individual; or
(iii)in the case of a partnership (other than a limited liability partnership), to any partner or other like officer of the partnership;
(b)by leaving a copy of the Declaration or notice —
(i)in the case of an individual, at the individual’s usual or last known place of residence with an adult apparently resident there, or at the individual’s business address with an adult apparently employed there; or
(ii)in the case of an owner or operator other than an individual, at the owner’s or operator’s business address;
(ba)if the owner or operator is an individual, by affixing a copy of the Declaration or notice in a conspicuous place at the individual’s usual or last known place of residence or at the individual’s business address;”; and
(b)by inserting, immediately before the words “registered post” in sub‑paragraph (c), the words “ordinary or”.
